5.68.005 General.

The provisions of this chapter shall apply to all carnivals, tent shows, open air shows, and shows or theatrical performances using any publicly owned or maintained halls, buildings, or park facilities. (Ord. 272 § 1 (part), 1983)

5.68.010 Definitions.

A.    “Applicant” means any person, business, franchisee, club, or community organization that sponsors or produces any carnival, circus, tent show, or open air show.

B.    “Carnival” means a show which consists of display booths containing games of skill or chance, or a booth in which food and/or products are offered for sale. A carnival may also consist of amusement rides and vehicles, such as ferris wheels, merry-go-rounds, and the like, of a temporary nature.

C.    “Circus or tent shows” means any show including acts or performances, which may be conducted as a commercial enterprise in conjunction with an established local enterprise or community organization, and use any publicly owned or maintained halls, buildings, or park facilities.

D.    “Open air shows” means any performances, daredevil acts, or shows that are performed in the out-of-doors or without aid of a tent, building, or other enclosure, and performed on either public or private property. (Ord. 272 § 1 (part), 1983)

5.68.020 Permits required.

Any person(s), business, franchisee, club, or community organization sponsoring or producing any carnival, circus, tent show, or open air show must make application with the city public works and community development department planning division for a permit in accordance with this chapter, and any use or temporary use permit as defined in Chapter 17.46 of this code at least sixty days prior to the date of the intended carnival, circus, tent show, or open air show. At the time of application, the applicant will supply the following information:

A.    Name, address, phone number, and date of birth of applicant;

B.    A statement as to the intended purpose of the carnival, circus, tent show, or open air show;

C.    A statement as to the types of city buildings, halls, and/or park facilities that are intended to be used;

D.    An estimate as to the number of persons and or vehicles that will be attending the carnival, circus, tent show, or open air show;

E.    An estimate as to the number of vehicles which will be used by the sponsors, producers, and operators of any carnival, circus, tent show, or open air show for the production of the show and located on the site;

F.    A site plan that will illustrate the locations of temporary or permanent fixtures, rides, displays, booths, arenas, stages, buildings, tents, trailers, trucks, and vehicles used in the production or operation of any carnival, circus, tent show, or open air show and their relationship with the proposed location, surrounding city streets, and adjacent public or private lands, buildings, or facilities;

G.    A parking and traffic flow plan which will illustrate the intended design of any temporary or permanent parking facilities, the surrounding city streets, and the placement of any temporary traffic channelization devices;

H.    A list of the proposed dates and hours of operation;

I.    A list of any sponsors or coproducers, including their names, addresses, and phone numbers;

J.    Name of person to be contacted in case of emergency at the time of the event; and

K.    Any other information or drawings as may be required by any head of a city department. (Ord. 272 § 1 (part), 1983)

5.68.030 Permit fees.

At the time of application, the applicant or his agent shall pay the city application fees, over and above any fees associated with the processing or as a result of the issuance of any use permit or temporary use permit. The permit fees shall be established by council resolution. (Ord. 272 § 1 (part), 1983)

5.68.040 Issuance of permit.

The city planning division, upon receipt of a completed application and permit fees, shall forward copies of said applications to all city departments that would be directly or indirectly affected by the issuance of a permit for review. Each of the departments shall then return to the planning division their recommendation for approval or denial, based on just cause, within a reasonable amount of time. The planning division shall make a recommendation to the city council for or against issuance of the permit. The city council shall then act within a timely manner and, finding no just cause for denial, shall issue said permit to the applicant. (Ord. 272 § 1 (part), 1983)

5.68.050 Unlawful public events.

Any person, business, franchisee, club, or community organization that produces or operates any carnival, circus, tent show, or open air show without a permit shall be guilty of a misdemeanor and subject to a fine of five hundred dollars per day of operation. For the purposes of this section, a day of operation shall commence at 12:01 a.m. Pacific Standard Time and include all hours until 12:01 a.m. Pacific Standard Time of the following day. Each day of operation shall be considered a separate violation of this code. (Ord. 272 § 1 (part), 1983)
