9.76.010 Generally.

It is unlawful for any minor under the age of eighteen years to loiter, idle, wander or stroll upon, about or in any of the public streets, avenues, alleys, parks, squares, playgrounds, public lots, public places, public buildings, vacant lots or other unsupervised places within the city between the hours of ten p.m. and the time of sunrise of the following morning, when not accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, except when the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor. 9.76.020 Parental responsibility.

It is unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of eighteen years knowingly to permit such minor to loiter, idle, wander or stroll upon, about or in any of the public streets, avenues, alleys, parks, squares, playgrounds, public lots, public places, public buildings, vacant lots or other unsupervised places between the hours of ten p.m. and sunrise of the following morning, except when the minor is accompanied by his or her parent, guardian or other adult person having care and custody of the minor, or except where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor. 9.76.030 Presence in tavern prohibited.

No proprietor, keeper, clerk or any person having charge or control of any cafe, tavern, saloon, bar, restaurant, eating place, drive-in restaurant, pool or billiard room or parlor, bowling alley or public dance hall, within the city, shall permit any minor under the age of eighteen years to be present in such public place between the hours of eleven p.m. and the time of sunrise immediately following, unless such minor is accompanied by a parent, guardian or other adult person having the care, custody or control of such minor. 9.76.040 Report of minor’s presence required when.

Each owner, agent, manager or keeper of a hotel, boardinghouse, lodging house, rooming house, tenement house, motor court, motel, bungalow court or apartment house in the city shall immediately report to the office of the chief of police of the city the presence therein, between the hour of ten p.m. and the time of sunrise immediately following, of any and all minors under the age of eighteen years, unless such minor is accompanied by his parent, guardian or other adult person having the care, custody or control of such minor. Such report shall contain the name, age, last-known place of residence of such minor, and the names and residence addresses of the parents, guardians or other persons having the care, custody or control of such minor, so far as such information can be ascertained by the person required in this section to make such report. 9.76.050 Violation—Permitting prohibited.

No parent, guardian or other person having the care, custody or control of any minor under the age of eighteen years shall allow or permit such minor to violate any provisions of this chapter. (Ord. 89 1 (part), 1974: prior code 7-303)

9.76.060 Violation—Aiding and abetting.

No person shall assist, aid, abet or encourage any minor under the age of eighteen years to violate any provision of this chapter. (Ord. 89 1 (part), 1974: prior code 7-304)

9.76.070 Violation—Presumptions.

When any minor is found violating any of the provisions of this chapter, a presumption shall arise that the parent, guardian or other person having the care, custody or control of such minor allowed, permitted, assisted, aided, abetted and encouraged such minor in such violation. 9.76.080 Violation—Punishment.

Any person violating the provisions of this chapter is guilty of a misdemeanor which shall be punishable in accordance with the provisions of Chapter 1.08 of this code; provided, that when any state law providing for the arrest, apprehension, hearing, trial and/or punishment of minors requires a different procedure for arrest, apprehension, hearing, trial and/or punishment of minors than that provided for in this code, such state law shall govern.
