ALCOHOLIC BEVERAGES

12.28.010 Guidelines.

Alcoholic beverages shall be permitted in parks and community buildings in accordance with the following guidelines:

A.    Alcoholic beverages may be served in any community building or portion thereof upon the issuance of an exclusive use permit.

B.    Alcoholic beverages may be sold in any community building or portion thereof upon the issuance of an exclusive use permit, which permit shall not be issued without the presentation of a valid alcoholic beverage control (A.B.C.) license.

C.    No exclusive use permit shall be issued permitting the service or sale of alcoholic beverages where minors will be present, except when food is also served.

D.    No exclusive use permit shall be issued permitting the service or sale of alcoholic beverages when, in the best judgment of the director of parks and recreation or the chief of police, such service or sale would not be in the best public interest.

E.    Individual use of alcoholic beverages shall be prohibited in all community buildings.

F.    Open containers of alcoholic beverages are not to be possessed, nor shall alcoholic beverages be consumed in any park, recreation center, beach, parking lot, or in any park and recreation facility or area except in locations specified by the director of parks and recreation. Applicants must comply with state Alcoholic Beverage Control requirements.

G.    Group service or sale of alcoholic beverages shall be prohibited in parks except with the issuance of an exclusive use permit and a valid A.B.C. license if alcoholic beverages are for sale. (Ord. 305 § 1, 1985; Ord. 240 § 1, 1981)

12.28.020 Drinking—Public places.

It is unlawful for any person to drink or possess any open container of beer, wine, or other intoxicating beverage on any public sidewalk, alley, street or highway. This section shall not be deemed to make punishable any such act or acts which are prohibited by the vehicle code or by any other law of the state. (Ord. 332 § 1 (part), 1986)

12.28.030 Drinking—Private parking lot.

It is unlawful for any person to drink or possess any open container of beer, wine or other intoxicating beverage upon that portion of private property open to the public and within five hundred feet of any public sidewalk, alley, street or highway, which is used or intended to be used for the parking or storage of motor vehicles by customers or employees of any business, commercial or industrial establishment without the express written permission of the owner, his agent or person in lawful possession thereof. This section shall not be deemed to make punishable any such act or acts which are prohibited by the vehicle code or by any other law of the state. (Ord. 332 § 1 (part), 1986)
