15.40.010 Purpose.

The ordinance codified in this chapter, is intended to limit and/or reduce the particulate emissions caused by the burning of specific fuels within fireplaces, stoves or appliances. (Ord. 486 § 1 (part), 2001)

15.40.020 Definitions.

For the purpose of this chapter, the following terms shall have the following meanings:

“Fireplace” means any permanently installed masonry or factory-built wood burning appliance, except a pellet-fueled wood heater, designed to be used with an air-to-fuel ratio greater than or equal to thirty-five to one.

“Garbage” means all solid, semisolid and liquid wastes generated from residential, commercial and industrial sources, including trash, refuse, rubbish, industrial wastes, asphaltic products, manure, vegetable or animal solids and semisolid wastes, and other discarded solid and semisolid wastes.

“Paints” mean all exterior and interior house and trim paints, enamels, varnishes, lacquers, stains, primers, sealers, undercoating, roof coatings, wood preservatives, shellacs, and other paints or paint-like products.

“Paint solvents” mean all original solvents sold or used to thin paints or to clean up painting equipment.

“Solid fuel” means wood or any other nongaseous or nonliquid fuel.

“Treated wood” means wood of any species that has been chemically impregnated, painted, coated or similarly modified to improve resistance to insects or weathering.

“Waste petroleum products” mean any petroleum product other than gaseous fuels that has been refined from crude oil, and has been used, and as a result of use, has been contaminated with physical or chemical impurities.

“Wood burning appliance” means a fireplace, wood heater, or pellet-fueled wood heater or any similar device burning wood or other nongaseous or nonliquid fuel used for aesthetic or space-heating purposes. (Ord. 486 § 1 (part), 2001)

15.40.030 Fuels for wood burning appliances.

A.    The burning of any of the following materials at any time in a fireplace, stove or wood burning appliance is discouraged:

1.    Garbage;

2.    Treated wood or wood composition products;

3.    Plastic products;

4.    Rubber products;

5.    Waste petroleum products, including tar or tar paper;

6.    Paints and paint solvents;

7.    Coal;

8.    Glossy paper.

B.    The use of any wood burning appliance when the Bay Area Air Quality Management District issues a “Spare the Air Tonight” warning and when an alternate approved heat source is available is discouraged. (Ord. 486 § 1 (part), 2001)
