8.32.010 Implementation of chapter.

A.    The city assumes responsibility for the implementation of Chapter 6.95 of Chapter 20 of the California Health and Safety Code (Sections 25500 et seq.), as the same may be amended from time to time, regarding business and area plans relating to the handling and release, or threatened release, of hazardous material.

B.    The fire department of the city shall be the administering agency for the provisions of this chapter and all other applicable statutes promulgated by the state or federal government. (Ord. 1475 § 5 (part), 1994)

8.32.020 Adoption of more stringent requirements when necessary.

The fire chief may adopt additional or more stringent requirements on businesses which handle hazardous waste than those set forth in the Health and Safety Code. (Ord. 1475 § 5 (part), 1994)

8.32.030 Fees.

A fee to defray the cost of implementing and maintaining the hazardous materials program shall be set by resolution of the city council. In addition to the regular fee, any person who fails to timely file a business plan shall pay a late fee which shall also be set by resolution of the city council. (Ord. 1475 § 5 (part), 1994)

8.32.040 Violation–Penalty.

Any person who violates Section 25507 of the Health and Safety Code shall be subject to the penalties set forth in Section 25515 of the Health and Safety Code, as the same may be amended from time to time. This section is supplemental to any other civil or criminal liability or penalty provided by law. (Ord. 1475 § 5 (part), 1994)
