ARTICLE XXXVI. SWIMMING POOLS AND OTHER BODIES OF WATER

30.36.10 Statement of intent.

The intent of this article is to regulate the location of swimming pools, spas, hot tubs, ponds, and other bodies of water deeper than eighteen (18) inches to safeguard life, health, property and the public welfare. (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)

30.36.20 Swimming pool, hot tub, and spa locations.

With the exception of fountains and other landscaping features, no swimming pool, spa, hot tub, pond, or body of water deeper than eighteen (18) inches shall be located in any required front yard setback area, or in any required side yard setback area on the street side of a corner lot, as required by the provisions of this article. In addition, the distance from the inner surface of a pool, spa, hot tub, pond, or body of water to any property line shall be not less than five (5) feet. (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)

30.36.30 Swimming pool fencing.

Fencing shall be provided to enclose all swimming pool areas as required by the “Swimming Pool Safety Act” (California Health and Safety Code Sections 115920 through 115928). (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)

30.36.40 Swimming pool mechanical equipment.

Swimming pool mechanical equipment, mounting pads, and/or enclosures shall not be located within three (3) feet of any side or rear property line, or within the front yard setback. Mechanical equipment shall comply with the noise restrictions contained within section 30.41.31. (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)
