ARTICLE LIII. ENFORCEMENT OF THE ZONING ORDINANCE

30.53.10 Vested duty.

All departments, officials and public employees of the city who are vested with the duty or authority to issue permits or licenses shall conform to the provisions of this chapter and shall issue no such permit or license for uses, buildings or purposes where the same would be in conflict with the provisions of this chapter and any such permit or license if issued in conflict with the provisions of this chapter shall be null and void. It shall be the duty of the planning director to enforce or cause to be enforced the provisions of this chapter pertaining to the erection, construction, reconstruction, moving, conversion, alteration, removal of or addition to any building, sign, structure, building site or parcel of land in the City of Gilroy. 30.53.20 Penalty and fine.

Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any of the provisions of this chapter shall be guilty of an infraction, and upon conviction thereof shall be punished as set forth in Government Code Section 36900, as it now exists or may hereafter be amended. The violating party shall be judged to be guilty of a separate offense for each and every day during any portion of which any violation of this chapter is committed, continued or permitted by such person, firm or corporation, and shall be punishable as herein provided. Nothing in this chapter shall be construed as to restrict the right of any individual to pursue redress by civil action of any violation of this chapter. (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)

30.53.30 Declaration of nuisance.

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved or maintained contrary to the provisions of this chapter and/or any use of any land, building or premises conducted, operated or maintained contrary to the provisions of this chapter shall be and the same is hereby declared to be unlawful and a public nuisance and the city attorney of the city shall, upon order of the city council, immediately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner provided by law and shall take such other steps and shall apply to such court or courts as may have jurisdiction to grant such relief as will abate and remove such building or structure and restrain and enjoin any person, firm or corporation from setting up, erecting, building, maintaining or using any such building or structure or using any property contrary to the provisions of this chapter.

The remedies for herein shall be cumulative and not exclusive. (Ord. No. 2013-08, § 2 (Exh. A), 8-5-13)
