8.04.010 Adopted by reference.

Title 6 of the San Mateo County Ordinance Code is adopted by reference as Title 8 of the Half Moon Bay Municipal Code, Animal Control.  In accordance with California Government Code Section 50022.4, no penalty clauses are adopted by reference.  In the event an amendment to Title 6 of the San Mateo County Ordinance Code results in differences between this title and the County Ordinance Code, the text of this title shall govern.  In accordance with California Government Code Section 50022.6, at least one true copy of Title 6 of the San Mateo County Ordinance Code has been on file with the Half Moon Bay city clerk since fifteen days prior to enactment of the ordinance codified in this title.  While this title is in force, a true copy of Title 6 of the San Mateo County Ordinance Code shall be kept for public inspection in the office of the Half Moon Bay city clerk.  A reasonable number of copies of Title 6 of the San Mateo County Ordinance Code shall be available in the office of the Half Moon Bay city clerk for public purchase.  In accordance with California Government Code Section 50022.3, a public hearing on the adoption of the ordinance codified in this title was held on November 1, 2005.  (Ord. 4-05 §1, 2005:  Ord. 9-99 §2, 1999).

8.04.020 Penalty for violation.

Any violation of Title 8 of the Half Moon Bay Municipal Code, as adopted by the ordinance codified in this title, including those provisions relating to required fees, shall be punishable as an infraction, the penalty for which shall be as follows:

A.    A fine not exceeding one hundred dollars for a first violation;

B.    A fine not exceeding two hundred dollars for a second violation of the same title within one year; and

C.    A fine not exceeding five hundred dollars of each additional violation of the same title within one year.  (Ord. 9-99 §3, 1999).
