12.12.010 Chapter purpose.

The purpose of this chapter is to promote and protect the public health, safety, comfort and general welfare by prohibiting the obstruction and littering of streets, sidewalks and public property.  (Ord. 6-62 §1, 1962).

12.12.020 Definitions.

The following definitions apply to this chapter:

A.    “Drainage facilities” include all drains, tunnels, conduits, culverts, channels, outlets, ditches, creeks, curbs, manholes, catch basins and all improvements, and appurtenances thereto of every nature, for drainage purposes in which the city and/or the public has any interest by virtue of dedication, condemnation or establishment by use, or otherwise.

B.    “Other public property” is any land or other property, other than streets or sidewalks as above-defined, in which the city and/or the public has any interest by virtue of dedication, condemnation, establishment by use, or otherwise.

C.    “Sidewalk” is any way or place of whatever nature open to the use of the public for purposes of pedestrian travel and which is not private property.

D.    “Street” is any way or place of whatever nature open to the use of the public for purposes of vehicular traffic and includes all land dedicated or condemned for that purpose, or established for that purpose by use.  (Ord. 6-62 §2, 1962).

12.12.030 Unlawful to deposit certain materials.

It is unlawful for any person to place, throw, spill or deposit, or cause to be placed, thrown, spilled or deposited, any rubbish, debris, earthen material, gravel, rock, cement, building materials, metal, wood, glass, paper, cloth, brokenware, cans, rubbish, refuse or garbage upon any street, drainage facility, sidewalk or other public property within the city so as to cause such street, drainage facility, sidewalk or other public property to be littered unsightly, or obstructed.  (Ord. 6-62 §3, 1962).

12.12.040 Obstruction of drainage facility.

It is unlawful for any person to place, or cause to be placed, in, on or about any drainage facility any object which will in any way affect the normal operation thereof or access thereto.  (Ord. 6-62 §4, 1962).

12.12.050 Nuisances.

Any earthen material, gravel, rock, cement, building materials, metal, woods, glass, paper, cloth, brokenware, cans, rubbish, refuse or garbage, and any goods, wares, merchandise, inventory, machinery, equipment, implements or other property placed, thrown, spilled or deposited on any street, drainage facility, sidewalk or other public property contrary to the provisions of this chapter is declared to be unlawful and a public nuisance.  (Ord. 6-62 §7, 1962).

12.12.060 Enforcement authority designated.

It shall be the duty of the police department to enforce the provisions of this chapter.  (Ord. 6-62 §5, 1962).
