6.46.010 Regulation of animals.

No person, whether owner or occupant, shall permit animals, except household pets as defined in Chapter 6.08 HMC, to reside, be placed on, located on or in structures which are residential in nature or in a residential zone as defined by this code. (Ord. 90-14 § 2, 1990)

6.46.020 Chickens as a nonconforming use.

Those households within the city having and maintaining chickens prior to the adoption of Ordinance No. 90-14, passed on November 26, 1990, regulating the species of animals permitted in residential zones, may continue to have and maintain chickens as nonconforming uses subject to the following terms and conditions which shall be observed within six months from the effective date of the ordinance codified in this section:

A. No person, owner or occupant may have more than 12 hens per household.

B. No roosters are permitted within the city limits.

C. All hens must be kept within the rear one-third of the residential lot as defined in HMC 17.12.290.

D. All hens must be kept at least 40 feet or more from any residence, including that of the owner of the hens, church, school, hospital or day care center.

E. All chickens shall be kept in a clean, sanitary and healthy condition and confined to the owners’ property. Animal waste, fecal matter, feathers or other chicken debris shall not be allowed to accumulate on any public or private property. Any such accumulation is declared a public nuisance.

F. No chicken shall be allowed to run at large. (Ord. 94-06 § 1, 1994)
