17.98.010 Purpose and application.

In enacting this chapter, the city council finds:

A. The utilization of earth-based stations for the reception of satellite signals is becoming increasingly more commonplace, especially for television reception.

B. It is the desire of the city to permit reasonable use by property owners of their property while protecting the rights of neighbors and others within the community from unsightly intrusion.

C. Satellite receiving dishes can create hazards for vehicular traffic, structures used to support dishes, persons and property near improperly installed satellite dishes.

D. Specific regulations regarding satellite receiving dishes are necessary to facilitate orderly and aesthetically pleasing development within the city.

E. Nothing in this title shall be construed to preempt any state or federal statute or the order, rule or regulation of any state or federal regulatory agency empowered to make any such order, rule or regulation. (Ord. 91-07 § 1, 1991)

17.98.020 Definitions.

All words used in the singular include the plural and the plural the singular; and any tense includes the other tenses unless the context requires otherwise. The world “shall” is mandatory and the word “may” is permissive. The following words and phrases have the meanings ascribed to them below, unless the context clearly indicates differently:

A. “Satellite receiving dish” means a device or instrument 24 inches or larger in diameter designed or used, for the reception of television or other electronic communications signal broadcast or relayed from an earth satellite. It may be solid, open mesh, or bar configured structure in the shape of a shallow dish or parabola. (Ord. 91-07 § 1, 1991)

17.98.030 Building permit.

No satellite receiving dish shall be installed without a building permit. (Ord. 91-07 § 1, 1991)

17.98.040 Installation requirements.

The following requirements shall be complied with in connection with the installation of a satellite receiving dish (hereafter “dish”):

A. The city shall encourage ground-level installation of all dishes.

B. Dishes installed on the side or top of any building shall require the approval of the city building official.

C. The dish shall be obscured from view of any public right-of-way to the extent possible. Any dish which cannot meet this requirement may nevertheless be permitted if the planning commission shall approve it.

D. The dish shall be placed a minimum of five feet from any property line.

E. The dish shall be securely mounted and anchored to the ground in accordance with the requirements of the manufacturer and the building code.

F. The dish shall not be permitted in front yards or, in the case of corner lots, a side yard.

G. All dishes to be installed in nonresidential zones shall be reviewed and approved by the planning commission under the provisions of a use permit.

H. All electrical and antenna wiring shall be placed underground or otherwise obscured from view.

I. All dishes shall be neutral in color and bear no advertising emblem or information other than the name of the manufacturer in letters not to exceed two inches in height.

J. There shall be no more than one dish on any parcel.

K. All dishes shall be effectively screened by a fence, wall or dense screen hedge to a maximum height of six feet. (Ord. 91-07 § 1, 1991)
