10.12.010 Applicability of provisions.

A.    The provisions of this chapter prohibiting the stopping, standing or parking of a vehicle shall apply at all times specified in this chapter, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device.

B.    The provisions of this chapter imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the state Vehicle Code or the ordinances of this city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 10.12.020 Compliance required generally.

A.    No person shall stop, stand or park a vehicle within any parkway, crosswalk or alleyway except as provided in this chapter, or except by permission of the owner, in any private driveway.

B.    No person shall stop, stand or park a vehicle for any purpose other than the loading or unloading of persons or materials or freight in any alley in the city. (Ord. 356 Art. II §2, Art. III §5, 1958)

10.12.030 Parallel parking.

A.    Subject to other and more restrictive limitations, a vehicle may be stopped or parked within eighteen inches of the lefthand curb facing in the direction of traffic movement upon any one-way street unless signs are in place prohibiting such stopping or standing as provided in this chapter.

B.    It is unlawful for any person to park any vehicle on any street where painted lines are drawn on such street for parallel parking, unless said vehicle is placed in such manner that both wheels on the righthand side of the vehicle are not more than eighteen inches distant from the curb, and unless the vehicle is so parked that no portion thereof extends over and above any of the painted lines drawn on the street to designate the parking area; provided, however, that any vehicle may be backed up to the curb of any street when actually engaged in loading or unloading freight if the traffic is not blocked thereby; and further provided, that the lines drawn parallel to the curb to so designate parallel parking shall not be less than seven feet from the curb, and the lines drawn at right angles to designate and separate the parking area shall not be less than twenty-two feet or more than twenty-four feet apart.

C.    It is unlawful for any person to stop or park any vehicle upon any street where the vehicle is stopped or parked facing a direction opposite to that in which traffic normally moves upon that half of the street on which such vehicle is stopped or parked. 10.12.040 Diagonal and perpendicular parking.

A.    It is unlawful for any person to park any vehicle diagonally or perpendicular to the curb or shoulder on any of the streets in the city except where marked for such diagonal or perpendicular parking with any portion of the vehicle, or its load, across or projecting across any painted or marked white lines upon the streets, or without the right front wheel of the vehicle being within six inches of the curb.

B.    The city council may from time to time by resolution designate certain areas for diagonal or perpendicular parking and shall cause white painted lines to be painted upon the street pavement designating such diagonal or perpendicular parking spaces. Such lines shall be spaced at intervals of no less than eight feet nor more than ten feet. (Ord. 496 §1, 1974)

10.12.050 Prohibited parking areas.

The city council may determine by resolution when standing or parking shall be prohibited upon either side of any street, or portion thereof, and shall erect appropriate signs or provide paintings or markings giving notice thereof as required in this chapter. (Ord. 356 Art. II §7, 1958)

10.12.060 Parking on hills.

No person shall park or leave standing any vehicle unattended on a highway, alley, street or roadway in the city when upon any grade exceeding three percent, without blocking the wheels by turning them against the curb or by other means. (Ord. 356 Art. II §8, 1958)

10.12.070 Double parking.

A.    Pursuant to the authority granted to the city council pursuant to Section 22502(c) of the California Vehicle Code, double parking on the south side of Fifth Street between Main Street and Forbes Street in the city is prohibited.

B.    The department of public works is directed to cause appropriate signs to be erected indicating the prohibited double-parking area in accordance with Section 10.12.220 of this chapter. (Ord. 650 §§1, 2, 1985)

10.12.080 Peddler and vendor parking restrictions.

A.    No person shall stand or park any vehicle, wagon or pushcart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunchwagon or eating car or vehicle, on any portion of any street within the city, without a permit therefor, except that such vehicles, wagons or pushcarts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten minutes at any one place.

B.    The provisions of this section shall not apply to persons delivering such articles upon order of, or by agreement with, a customer from a store or other fixed place of business or distribution.

C.    The city council may from time to time issue permits for the parking of vehicles, wagons or pushcarts for the sale of goods, wares or merchandise, as provided in this section, in such form as it may prescribe, upon application therefor designating the area or specified location where such applicant shall be permitted to park. 10.12.090 Parking time limited in specific places.

The city council may, by resolution, determine where parking shall be limited to two consecutive hours, and shall cause to be erected appropriate signs giving notice thereof as hereinafter required. This restriction shall apply only during the hours between six a.m. and six p.m. of any day except Sundays and holidays.

A.    Requirement to Vacate Parking Stall. Pursuant to the provisions of this section a vehicle operator is required, by the end of the two-hour parking limit, to vacate the parking stall entirely and move the vehicle to another parking stall.

B.    Removal of Timing Mark Placed on Vehicle Tire by Parking Enforcement Officer. Any vehicle operator who removes a mark placed on a vehicle tire for purposes of determining the time a vehicle has been parked shall be guilty of an infraction and subject to a fine not to exceed one hundred dollars. 10.12.100 Early morning parking limited in certain areas.

It is unlawful for the operator of any vehicle to park the vehicle for a period of more than thirty minutes between the hours of one-thirty a.m. and six a.m. of any day except Sundays and holidays on any streets or portions of streets within that areas bounded by the south side of Armstrong on the south, the north side of Sixth Street on the north, the west side of Forbes Street on the west, and the shore of Clear Lake on the east and along both sides of Main Street extending north to the south side of Clear Lake Avenue and south to the north line of Lakeport Boulevard. 10.12.110 Emergency no-parking zones.

A.    Whenever the chief of police determines that an emergency traffic congestion is likely to result, the chief of police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets, or any portion or part thereof. Such signs shall remain in place only during the existence of such emergency and the chief of police shall cause such signs to be removed promptly thereafter.

B.    Emergency traffic signs provided for in this section shall not be less than fifty feet apart and shall clearly indicate no parking or other traffic restriction intended. (Ord. 356 Art. II §§10, 14, 1958)

10.12.120 Painted curbing--Interpretation.

Local stopping, standing or parking in the city shall be regulated as indicated by different colored paint upon the curbs, and shall be effective unless otherwise herein designated between the hours of six a.m. and six p.m. during all business days, Sundays and holidays being excepted from the operation of subsections B and D of this section:

A.    Red paint marks on the curb indicate no stopping, standing or parking, whether the vehicle is attended or unattended, at any time including Sundays and holidays. Provided, however that the city council may from time to time designate certain areas by resolution for a particular use by emergency vehicles, vehicles of state, city or county, police, doctor or taxi or public transit bus, printing on the curb, over such red paint, the limited use thereof by appropriate white letters not less than three inches high, and when said curbs are so painted and imprinted, it shall be unlawful for any vehicle to stop, stand or park adjacent thereto, except the particular vehicles so permitted as indicated by said printing.

B.    Yellow paint marks upon the curb indicates stopping only for the purpose of loading or unloading passengers or freight.

C.    White paint marks on the curb indicate stopping only for the purpose of loading or unloading of passengers and shall be effective at all times including Sundays and holidays.

D.    Green paint marks on the curb indicate a time limit for parking of twenty minutes in duration.

E.    White lines drawn diagonally to the curb on the street indicates diagonal parking.

F.    White lines on the street drawn parallel to the curb shall designate parallel parking, and intersecting lines at right angles to the curbs designate separate areas for such parking. (Ord. 783, 1996; Ord. 761, 1993; Ord. 370 §1, 1960; Ord. 356 Art. III §1, 1958)

10.12.130 Painted curbing--Limitation of yellow zones.

No vehicle shall be stopped, left standing or parked adjacent to a yellow zone, except commercial vehicles, and then only for the purpose of loading or unloading of passengers or freight and shall not be left standing, stopped or parked for longer than the time necessary for such loading, and in no event for more than twenty minutes. 10.12.140 Painted curbing--Limitation of white zones.

No vehicle shall be stopped, left standing or parked adjacent to a white zone except for the purpose of unloading passengers, but unloading includes the loading or unloading of personal baggage, but shall not extend beyond the time necessary therefor, and in no event for more than three minutes. 10.12.150 Handicapped parking.

A.    Persons using blue-curb parking spaces shall comply with the following:

1.    No person shall park or stand any vehicle in a disabled-persons parking zone (blue curb) unless said vehicle bears a special license or displays a special placard issued under the provisions of Section 9105 or Section 22511.5 of the California Vehicle Code. “Display” as used in this section shall mean to place the placard in a clearly visible area where it can be viewed by a person looking into the interior of the vehicle from the sidewalk or curb area when the vehicle is parked. The placard shall not be obstructed or blocked from the outside view in any manner. Any person failing to clearly display a special placard as required herein so as to be clearly visible to parking or law enforcement personnel shall be guilty of an infraction and subject to a fine not to exceed twenty dollars.

2.    Blue-curb parking spaces shall be operative twenty-four hours a day, Sundays and holidays included.

3.    Parking zones for the physically handicapped are subject to any temporary parking prohibitions established by the city council.

B.    On-street Parking.

1.    The city council shall designate by resolution, special blue-curb parking spaces for the purpose of providing on-street parking for exclusive use by physically handicapped persons.

2.    On-street blue-curb spaces shall be indicated by blue paint on the curb edge of the paved portion of the street. In addition, there shall be posted immediately adjacent to, and visible from each stall or space, a sign consisting of a profile view of a wheelchair with occupant in white on a blue background.

C.    Off-street Parking--Publicly Owned Facilities.

1.    The city council shall designate by resolution, parking stalls or spaces in publicly owned, leased or controlled off-street parking facilities for exclusive use by physically handicapped persons.

2.    Designation of off-street, publicly owned facilities shall be made by posting immediately adjacent to and visible from each stall or space, a sign consisting of a profile view of a wheelchair with occupant in white on a blue background.

D.    Off-street Parking--Privately Financed Facilities.

1.    The city council declares that there are privately owned and operated parking facilities which may reserve parking stalls for exclusive use by physically handicapped persons.

2.    Designation of off-street privately financed facilities shall be made by posting immediately adjacent to, and visible from each stall or space, a sign consisting of a profile view of a wheelchair with occupant in white on a blue background.

E.    Locations of blue curbs shall be designated by resolution. (Ord. 773, 1995; Ord. 598 §§1-3, 1981: Ord. 557 Arts. I--VI, 1978)

10.12.160 Loading or unloading--Time limits.

Within the total time limits specified in this chapter, the provisions of this chapter shall be enforced so as to accommodate necessary and reasonable loading or unloading, but without permitting abuse of the privilege hereby granted. (Ord. 356 Art. III §4, 1958)

10.12.170 Exemptions--Government agency vehicles.

The provisions of this chapter regulating the parking or standing of vehicles shall not apply to any vehicle of the city department or a public utility while necessarily in use for construction or repair work, or any vehicle owned by the United States while in use for the collection, transportation or delivery of the United States mail. (Ord. 356 Art. IX §3, 1958)

10.12.180 Permit for overtime parking.

A.    The chief of police may upon application therefor issue a special permit to park any vehicle or other equipment in a parking area on a city street, for a period not to exceed three days unless renewed by application.

B.    The chief of police may upon application therefor issue a special parking permit to a property owner or tenant of a residence without access to on-site parking within the central business zoning district subject to the following requirements:

1.    Permit shall allow for parking within designated two- and four-hour parking zones not located in front of a business or commercial building.

2.    Permit shall be limited to one vehicle per verified residence.

3.    Permit shall be renewed annually. (Ord. 899 §1, 2015: Ord. 484 §2, 1975)

10.12.190 Removal of vehicles parking over allowable time limits.

A.    No person shall park any vehicle upon any street or alley in the city for more than a consecutive period of seventy-two hours.

B.    Any police officer of the city may remove any vehicle parked on a public street within the city for more than a consecutive period of seventy-two hours or for any of the causes set forth in Section 22651 of the Vehicle Code of the state; provided, however, that the procedure for such removal shall be in accordance with the requirements of such Section 22651. 10.12.200 Parking for purpose of vehicle sale or repair prohibited.

No person shall park a vehicle upon any roadway or city property for the principal purpose of displaying such vehicle for sale or for greasing or repairing such vehicle, except when such greasing or repairs are necessitated by an emergency. (Ord. 678 §1, 1988: Ord. 356 Art. II §4, 1958)

10.12.210 Boat trailer parking.

A.    The city council may from time to time by resolution designate certain areas where boat trailers only may be parked at certain times or where no boat trailers may be parked at certain times, and shall cause appropriate signs to be erected clearly indicating the limitation thereof, and the time or times when other parking is prohibited which such signs shall be not less than one hundred fifty feet apart.

B.    It is unlawful to park any other vehicle in an area where signs are erected and in place as provided in subsections (A) and (C) of this section except boat trailers when permitted.

C.    The city council may from time to time by resolution designate certain areas as restricted parking areas and shall cause appropriate signs to be erected clearly indicating the limitation thereof, the signs shall be not less than one hundred fifty feet apart. (Ord. 524 §§1--3, 1976)

10.12.220 Signposting generally.

The city council shall cause appropriate signs to be erected along either side of any street or any portion thereof where parking is prohibited indicating no parking, or where parking is limited indicating the limitation thereof, which signs shall not be more than two hundred feet apart and there shall be at least one sign at each end of such restricted area, and the provisions of this section shall not be effective unless such signs are in place; provided, however, that no parking or limited parking in specific areas may also be indicated by painting on the curbs of the streets as provided in this chapter.
