FEE REFUND REQUIREMENTS

1.11.010 Applicability.

Notwithstanding any other provisions of the Marysville Municipal Code to the contrary, the provisions of this chapter shall only apply to city fees set out in the city fee schedule, as changed from time to time pursuant to ordinance of the city, and paid on or after July 1, 2001. (Ord. 1273 § 1 (part), 2001).

1.11.020 Time for requesting refund.

Any request for a fee refund shall be filed not later than sixty days after the fee is paid, unless the city council finds that sufficient good cause exists to allow the request to be made after sixty days. (Ord. 1273 § 1 (part), 2001).

1.11.030 Procedures.

Within the time limits described in Section 1.11.020, any person or other entity who has paid a fee, or a member of the city council on behalf of a person or entity who has paid a fee, may request a fee refund by obtaining and completing a form provided for that purpose by the city clerk. The city council will consider the request within thirty days from filing of request. There shall be no fee required to file for a fee refund. (Ord. 1273 § 1 (part), 2001).

1.11.040 City council approval.

The city council may, by resolution, approve of a fee refund based on a finding of sufficient good cause presented to the city council. The resolution shall contain sufficient findings to demonstrate the good cause presented to the city council for the fee refund. A partial refund may also be approved by the city council. 1.11.050 Refunds.

When any refund becomes due and owing by virtue of action of the city council, the city manager, or his or her designee, is authorized to make such refund and to expend such public moneys from the city treasury within thirty days of approval by the city council pursuant to Section 1.11.040.
