10.56.010 Title.

This chapter shall be known and may be cited as the "truck restrictions" and shall hereinafter be referred to in this chapter as "this code." (Ord. 1106 § 1 (part), 1991).

10.56.020 Purpose.

(a)    It is the intent of the city council in adopting this code to provide a comprehensive system of streets to be truck routes within the city and to restrict the operation of all vehicles in excess of seven thousand pounds empty weight to the truck routes established in this chapter.

(b)    It is the intent of the city council to prevent damage and deterioration of city streets by limiting the operation of certain types of vehicles in excess of seven thousand pounds empty weight only to those city streets designated as truck routes within this code.

(c)    It is the intent of the city council to provide a waiver from the requirements of this code to certain vehicles in excess of seven thousand pounds empty weight when the vehicles are conducting certain services described within this code.

(d)    Provisions of this code are to be supplementary and complementary to all of the provisions of this code, state law and any law cognizable at common law or in equity, and nothing in this chapter shall be read, interpreted or construed in any manner so as to limit any existing right or power of the city. 10.56.030 Truck routes established.

The following streets or portions of streets in this city are defined, designated and established as "truck routes" and shall be governed by the provisions of Section 10.56.040:

(a)    The following east-to-west streets or portions of streets:

(1)    3rd Street, west of E Street to J Street,

(2)    5th Street, west of E Street to west city limits,

(3)    10th Street, east of B Street to Ramirez Street,

(4)    18th Street, east of B Street to Chestnut Street,

(5)    17th Street, east of Chestnut Street to Yuba Street,

(6)    24th Street, east of B Street to Sampson Street (Special Permit Only-Section 10.80.010),

(7)    25th Street, east of Sampson Street to Covillaud Street (Special Permit Only-Section 10.80.010),

(8)    26th Street, east of Covillaud Street to north city limits (Special Permit Only-Section 10.80.010).

(b)    The following south-to-north streets or portion of streets:

(1)    J Street, north of 3rd Street to 5th Street,

(2)    Chestnut Street, north of E. 17th Street to E. 18th Street,

(3)    Yuba Street, north of 6th Street to E. 17th Street,

(4)    Ramirez Street, north of E. 10th Street to E. 12th Street. (Ord. 1363 § 1, 2014; Ord. 1208, 1995; Ord. 1122 § 1, 1991; Ord. 1106 § 1 (part), 1991).

10.56.040 Restricted streets prohibitions—Exceptions.

(a)    The operator of any vehicle exceeding seven thousand pounds empty weight shall drive only on the truck routes enumerated in Section 10.56.030 of this chapter. All other streets within the city are deemed restricted streets and shall not be used by vehicles in excess of seven thousand pounds empty weight, except that nothing in this section shall prohibit the operator of any such vehicle from any designated state highway or truck route from having ingress and egress by direct route only to and from restricted streets when necessary for the purpose of:

(1)    Making pickups and deliveries of goods, wares, materials and merchandise from or to any building or structure located on such restricted street; or

(2)    Delivering materials to be used in the actual and bona fide repair, alteration, remodeling or rehabilitation, or construction of any building, structure or home/business improvement upon such restricted streets for which a building permit has been obtained or for such other work not requiring a building permit; and

(3)    Obtaining food or lodging at any commercial restaurant or motel located on a restricted street.

(b)    The provisions of this code shall not apply to:

(1)    Passenger buses under the jurisdiction of the Public Utilities Commission; or

(2)    Any vehicle owned by a public utility or franchise service company while necessarily in use in the construction, installation or repair of any utility facility or franchised service facility located on a restricted street; or

(3)    Private "house cars" as that term is defined in Section 362 of the California Vehicle Code; or

(4)    Buses operated by any school district or private school; or

(5)    Refuse collection vehicles with a route or destination along a restricted street; or

(6)    All vehicles operated by a public agency and displaying an exempted license plate;

(7)    All tow trucks as defined by Section 615 of the California Vehicle Code.

(c)    Notwithstanding the provisions of subsection (a) and (b) of this section, no operator of any vehicle shall operate a vehicle with a weight in excess of the loads limits provided in the California Vehicle Code without first obtaining a written permit from the public works director in accordance with the provisions of Chapter 10.80 of this code. 10.56.050 Prohibited truck parking.

(a)    The operator of any vehicle in excess of seven thousand pounds empty weight shall not at any time cause any said vehicle to be parked upon or in any street not designated as a truck route pursuant to Section 10.56.030; provided, that such vehicle may be parked off of an established truck route for the purpose of permitting the operator to obtain food or lodging at a commercial restaurant or a motel.

(b)    The city council may, by resolution, prohibit the operator of any vehicle in excess of seven thousand pounds empty weight from parking the vehicle upon or in a truck route or a portion of a truck route thereof if the city council determines that such parking would create an unsafe, undesirable, or hazardous condition. 10.56.060 Truck route and restricted street signing.

(a)    The public works director is authorized to designate such streets or portion of streets, as designated within this code as truck routes by appropriate signs as either a "through truck route," or "Commercial Truck Access Route — Through Truck Traffic Prohibited" along with any other signs deemed necessary and appropriate by the public works director, along with any necessary arrows or delineation devices. The signs shall be posted and maintained by the public works department, at any location deemed necessary by the public works director to establish the truck route system.

(b)    The public works director is authorized to designate such streets or portion of streets, not designated as a truck route within this code, by a sign or signs stating "No Trucks over 7000 Pounds Empty Weight" along with any other signs deemed necessary and appropriate by the public works director. The signs shall be posted and maintained by the public works department, at any location deemed necessary by the public works director to establish a system of restricted streets.
