Article I. Planning Commission

2.10.010 Creation – Members – Term – Vacancy.

A planning commission is created and shall consist of five members who shall be appointed by the city council and serve at the council’s pleasure from the qualified electors of the city, none of whom shall hold any paid office or employment in the city government. Each member shall serve for a term of four years commencing on July 1st and continuing until his or her respective successor is appointed and qualified. The four-year terms of the commission members shall be staggered. In order to achieve staggered terms, half of the members first appointed to the commission shall be assigned by lot a term for two years and the other half of the commission members shall be assigned by lot a term for four years. All members must remain residents of the city while serving on the planning commission. The members shall not receive any compensation for their attendance of commission meetings or any other services rendered as a commission member; provided, however, that any actual and necessary expenses incurred by a commission member in the performance of his or her duties on the commission may be ordered paid by the city council. Any vacancy occurring other than by expiration of a term of office shall be filled by appointment for the unexpired portion of the term. 2.10.020 Powers and duties.

A.  After the public hearing thereon, recommend to the city council the adoption, amendment or repeal of master, general or precise plans, or any part thereof, for the physical development of the city.

B.  Exercise such functions with respect to land subdivisions, planning and zoning as may be prescribed by ordinance. (Ord. 354, § 3; 1976 Code § 2-2.102; 1966 Code § 2101).

2.10.030 Meetings.

The planning commission shall hold at least one regular meeting in each month at such time and place within the city as the commission may determine by resolution. Three members of the commission shall constitute a quorum for the transaction of business. A majority of the quorum present shall have the authority to act on any matter regularly coming before the commission. Meetings may be adjourned or special meetings called in compliance with the provisions of the Ralph M. Brown Act (commencing with Government Code Section 54950) or as hereafter amended or added to. 2.10.040 Rules.

The planning commission by resolution may adopt rules for the election and terms of its officers, for the transaction of business, and shall keep a record of its resolutions, transactions, findings and determinations, which shall be a public record. Seven of the members shall be qualified electors of the city and shall serve for a term of four years commencing on July 1st and continuing until their respective successors are appointed and qualified. The four-year terms of the commission members shall be staggered. In order to achieve staggered terms, half of the members first appointed to the commission shall be assigned by lot a term for two years and the other half of the commission members shall be assigned by lot a term for four years. The remaining two members shall be high school student representatives who are also residents of the city and who shall have all membership privileges and one of whom shall be appointed for a term of one year and the other of whom shall be appointed for a term of two years from the date of their respective appointments and continuing until their respective successors are appointed and qualified. All members must remain residents of the city while serving on the parks and recreation commission. The members shall not receive any compensation for their attendance of commission meetings or any other services rendered as a commission member; provided, however, that any actual and necessary expenses incurred by a commission member in the performance of his or her duties on the commission may be paid if funds are available in the budget approved by the city council and the individual expenses are approved by the city manager or designee. Any vacancy occurring other than by expiration of a term of office shall be filled by appointment for the unexpired portion of the term. 2.10.060 Duties.

The parks and recreation commission shall have the following duties:

A.  To recommend to the city council the establishment of an adequate system of parks, playgrounds and any other recreation facility which the commission may deem advisable including operation, management and maintenance of such facilities and the acquisition of necessary equipment;

B.  To recommend to the city council the acquisition of such real and personal property as may be necessary or advisable for recreational facilities;

C.  To recommend and make suggestions concerning any matter pertaining to parks and playgrounds and other recreational facilities which may be brought before the city council;

D.  To recommend fees or charges to be paid by residents and nonresidents for the use of city recreational facilities; provided, however, the city council at any time may review the fees or charges and abolish, change or modify such fees or charges or take such other action as the city council deems necessary in connection therewith. 2.10.100 Duties.

The Millbrae arts commission shall have the following duties:

A.  To advise the city council on all matters affecting the culture of the city and to advise and assist other city boards and commissions in the field of the fine arts, and to cooperate and work with the parks and recreation commission;

B.  To encourage programs in the fine arts and to promote the cultural enrichment of the community;

C.  To establish an effective liaison between the city and local cultural and artistic groups;

D.  To review and make recommendations upon all works of art to be acquired by the city, either by purchase, gift or otherwise, and with respect to their locations;

E.  To undertake and carry out all functions reasonably necessary to accomplish the objectives and to discharge the functions of the commission; and to exercise such other functions as may be prescribed by the city council. (Ord. 388, § 2; Ord. 370, § 1; 1976 Code § 2-2.302; 1966 Code § 2136).

Article IV. Community Preservation Commission

A community preservation commission is created and shall consist of ten members who shall be appointed by the city council and serve at the council’s pleasure, none of whom shall hold any paid office or employment in the city government. Eight of the members shall be qualified electors of the city and shall serve for a term of four years commencing on July 1st and continuing until their respective successors are appointed and qualified. The four-year terms of the commission members shall be staggered. In order to achieve staggered terms, half of the members first appointed to the commission shall be assigned by lot a term for two years and the other half of the commission members shall be assigned by lot a term for four years. The remaining two members shall be high school student representatives who are also residents of the city and who shall have all membership privileges and one of whom shall be appointed for a term of one year and the other of whom shall be appointed for a term of two years from the date of their respective appointments and continuing until their respective successors are appointed and qualified. 2.10.140 Duties.

The Millbrae community preservation commission shall have the following duties and objectives:

A.  To maintain and enhance the beauty of Millbrae through the following measures:

1.   By developing and recommending to the city council for its approval methods which will address all pertinent issues affecting the beauty of Millbrae; and

2.   By educating Millbrae residents consistent with city council policy in all matters which affect the beauty of Millbrae.

B.  To act as liaison with city organizations, as follows:

1.   To provide input to other city commissions and committees with respect to landscaping proposal standards as they affect the beauty of Millbrae;

2.   To establish an effective liaison with the chamber of commerce, and cooperate with commercial and industrial associations and private land owners, to recommend standard criteria for the beautification of existing building sites by landscaping and other means; and

3.   To provide input to and advise the park and recreation department in the development of a master street plan and official tree list, and to offer recommendations with respect to the following:

a.   Programs for the planting, maintenance and removal of all street trees; and

b.   Suitable plans for the planting, care and maintenance of street trees and of shrubs, grass plots and other ornamental or beautifying plantings upon the streets and highways.

C.  To act in concert with the city council, as follows:

1.   The commission shall perform such other duties as may be assigned to it by the city council; and

2.   No acts of the commission shall be contrary to the established policy of the city council. (Ord. 664-A, § 5; Ord. 542, § 1, Amended by Ord. 563, § 1; 1976 Code § 2-2.402).

The Millbrae community preservation commission by resolution may adopt rules for the election and terms of its officers, for the transaction of business, and shall keep a record of its resolutions, transactions, findings and determinations, which shall be a public record. Article V. Sister City Commission

2.10.170 Creation – Members – Term – Vacancy.

A sister city commission is created and shall consist of fifteen members who shall be appointed by the city council and serve at the council’s pleasure, none of whom shall hold any paid office or employment in the city government. Thirteen of the members shall be qualified electors of the city and shall serve for a term of four years commencing on July 1st and continuing until their respective successors are appointed and qualified. The four-year terms of the commission members shall be staggered. In order to achieve staggered terms, half of the members first appointed to the commission shall be assigned by lot a term for two years and the other half of the commission members shall be assigned by lot a term for four years. The remaining two members shall be high school representatives who are also residents of the city and who shall have all membership privileges and one of whom shall be appointed for a term of one year and the other of whom shall be appointed for a term of two years from the date of their respective appointments and continuing until their respective successors are appointed and qualified. All members must remain residents of the city while serving on the sister city commission. The members shall not receive any compensation for their attendance of commission meetings or any other services rendered as a commission member; provided, however, that any actual and necessary expenses incurred by a commission member in the performance of his or her duties on the commission may be paid if funds are available in the budget approved by the city council and the individual expenses are approved by the city manager or designee. Any vacancy occurring other than by expiration of a term of office shall be filled by appointment for the unexpired portion of the term. 2.10.180 Duties.

The sister city commission shall have the following duties and objectives:

A.  Promote a greater global understanding of other cultures and an international perspective for the citizens of Millbrae in light of the significant changes happening throughout the world by:

1.   Establishing exchange programs through local residents, businesses, schools, churches and similar entities and institutions.

2.   Encouraging foreign language study and assisting newcomers in learning English and our culture.

3.   Identifying and promoting trade relationships.

4.   Drawing upon the diverse population of Millbrae to include representation from as many groups as possible.

B.  To act as a liaison with city organizations and the city council as follows:

1.   Develop a program plan consisting of projects, exhibits, contacts and exchanges of all types which will foster and promote the objectives and purposes of the commission. The program plan shall be submitted to the city council for its approval.

2.   Implement and carry out the approved program plan upon request of the city council with the understanding that no fund raising activities shall be carried out and no expense of any kind shall be incurred in connection with the commission activities without the prior approval of the city council.

3.   Keep the community informed concerning the sister city program.

4.   Advise the city council, upon its request, on matters pertaining to any sister city affairs.

5.   Perform such other duties as may be assigned to the commission by the city council from time to time. No act or decision of the commission shall be contrary to the established policy of the city council or any other applicable governmental policy at the local, state or federal level.
