SPECIAL FUNDS

1.12.010 Capital Outlay Fund.

A. A fund is hereby created for capital outlays under the provisions of Act No. 8496A of the Legislature of the State of California entitled “An Act to provide for the levy and collection of taxes and assessments for the purpose of creating a fund for capital outlays by cities, counties, cities and counties or districts,” approved July 1, 1937, and being Chapter 717 of the Statutes of 1937, as amended1.

B. Such fund shall be known as “Special Fund for Capital Outlays” and it shall remain inviolate for the making of any capital outlays and no moneys shall be disbursed therefrom excepting for such a purpose, excepting upon the consent of the electors obtained as provided in said Act, as amended.

C. Taxes may be levied upon the taxable property in the City for the raising of moneys for said fund, but no levy so made shall exceed the limitation imposed by the general laws of the State upon the right of the City to impose taxes without the assent of two-thirds of the qualified electors of the City voting at any general or special election at which such proposition may be submitted.

D. The City Council may transfer to such fund any unencumbered surplus funds remaining on hand in the City at the end of any fiscal year. (Ord. 149, 2-13-1945)

1.12.020 Peace officers standards and training, aid for.

A. The City Council hereby declares that it desires to qualify to receive aid from the State of California under the provisions of Chapter 1 of Title 4, Part 4 of the California Penal Code.

B. Pursuant to Section 13522 of said Chapter 1, the City will adhere to the standards for recruitment and training established by the California Commission on Peace Officer Standards and Training. (Ord. 262, 9-14-1971)

1.12.030 Street Improvement Fund.

A. To comply with the provisions of Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code, with particular reference to amendments made thereto by Chapter 642, Statutes of 1935, there is hereby created in the City Treasury a special fund to be known as the “Special Gas Tax Street Improvement Fund.”

B. All moneys received by the City from the State of California under the provisions of the Streets and Highways Code for the acquisition of real property or interests therein for, or the construction, maintenance or improvement of, streets or highways other than State highways shall be paid into said fund.

C. All moneys in said fund shall be expended exclusively for the purposes authorized by, and subject to all of the provisions of Article 5, Chapter 1, Division 1 of the Streets and Highways Code of the California Statutes2. (Ord. 119, 10-8-1935)
