2.20.010 Rebuttal arguments.

Submission and filing of rebuttal arguments to arguments in favor of or against city ballot measures shall be subject to the following regulation and requirements:

(a) Except as provided by this section, California Elections Code Section 5014.5 shall apply to rebuttal arguments.

(b) A rebuttal argument may be submitted and filed by a person or persons who have not previously submitted and filed an argument for or against a city measure.

(c) If more than one rebuttal argument is submitted and filed to the argument in favor of or argument against the city measure, the city clerk shall select one rebuttal and shall give preference and priority in the following order:

(1) A person or persons who previously have filed an argument in favor of or argument against the city measure, consistent with the proposed rebuttal argument;

(2) The legislative body, or member or members of the legislative body authorized by that body;

(3) An individual voter or bona fide association of citizens, or combination of voters and associations, who are the bona fide proponents or opponents of the measure;

(4) Bona fide association of citizens;

(5) Individual voters who are eligible to vote on the measure.

(d) This section shall not apply to initiatives and referendums. [Ord. 1723 N.S. § 1, 1990].
