8.32.010 Definitions.
As used in this chapter, the following terms shall have the following meanings:
(A) “Bicycle” means and includes any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears and which has wheels at least 12 inches in diameter and a frame size of at least 14 inches.
(B) “Roller skates” means any device or shoe which has wheels attached to it by any means whatsoever and which is intended to be propelled by pushing, pulling, or by the forces of gravity and to which there is not affixed any mechanism for steering.
(C) “Skateboard” means any board or flat object which has wheels attached to it by any means whatsoever and which is intended to be propelled by pushing, pulling, or by the forces of gravity and to which there is not affixed any device or mechanism for steering.
(D) “Skate park” means any facility designed and maintained for the purpose of recreational skateboard or roller skate use, and includes a skateboard park as set forth in California Health and Safety Code Section 115800. (Ord. 1319 § 1, 2007; Ord. 1164 § 1, 2000; Ord. 693 § 1, 1987)
8.32.020 Prohibited activities.
(A) It is unlawful for any person to skate, use, ride or otherwise operate any skateboard or roller skates within, upon or over any public transportation parking lot, building or facility.
(B) It is unlawful for any person to skate, use, ride or otherwise operate any skateboard, roller skates, or bicycle upon or over private property posted by the property owner, tenant or manager, with clearly legible and visible signs prohibiting such activity. 8.32.040 Applicability.
The provisions of this chapter shall not be applicable to any person merely walking a bicycle or carrying a skateboard or roller skates in the areas designated herein, except that any person within the confines of a skate park shall wear a helmet, elbow pads, and knee pads at all times. The provisions of this chapter shall not be applicable to any Peace Officer who, in the performance of official duties, operates a bicycle upon or over any parking lot, private roadway, street, sidewalk or walkway of any shopping center, or skate park within the City. 8.32.045 Requirements for the use of publicly owned or publicly operated skate parks.
(A) The use of bicycles at a publicly owned or publicly operated skate park is prohibited.
(B) Every person within the confines of, or who is on roller skates or a skateboard at a publicly owned or publicly operated skate park shall wear a helmet, elbow pads and knee pads at all times. The Director of Parks and Recreation shall promulgate rules or regulations applicable to the supervision and use of a publicly owned or publicly operated skate park including, but not limited to, hours of operation, admission requirements, use of the facility, and waivers of liability, and shall cause such rules or regulations to be posted at the facility. Such rules or regulations may be enforced by a Peace Officer, Public Security Officer or any person otherwise designated by the Director of Parks and Recreation by suspension, termination or other restriction of access to the facility and by prosecution under PMC 8.32.050. Failure to comply with an order to leave or stay away from the facility is a separate offense and may be prosecuted as either an infraction or misdemeanor.
(C) The owner or operator of a recreational skate park shall post signs at that facility affording reasonable notice that: (1) the use of bicycles at the facility is prohibited; (2) every person within the confines of, or who is on roller skates or a skateboard at a skate park must wear a helmet, elbow pads and knee pads at all times; (3) failure to comply with these or any other rule or regulation promulgated by the Director of Parks and Recreation is unlawful and may be enforced by suspension, termination or other restriction of access to the facility and by prosecution under PMC 8.32.050; and (4) failure to comply with an order to leave or stay away from the facility is a separate offense and may be prosecuted as either an infraction or misdemeanor. 8.32.050 Violations.
Any person who, while within the confines of a skate park, or while operating a skateboard, roller skates or bicycle, violates any provision of this chapter, or any other rule or regulation promulgated by the Director of Parks and Recreation pursuant to this chapter is guilty of an infraction. The failure to comply with an order to leave or stay away from a skate park is a separate offense and may be prosecuted as either an infraction or misdemeanor.
