10.04.010 Los Angeles County Code Divisions 1 and 2 adopted as the Palmdale Vehicles and Traffic Code.

Except as hereinafter provided, Divisions 1 and 2 of Title 15, “Vehicles and Traffic,” of the Los Angeles County Code, in effect on January l, 1998, and as amended up to and including Los Angeles County Ordinance No. 97-0039, is adopted by reference and shall constitute the vehicles and traffic code of the City. It may be cited as the “Palmdale vehicles and traffic code.” (Ord. 1129 § 1, 1998; Ord. U-1129 § 2, 1998; Ord. 953 § 1, 1991)

10.04.015 Authority to appoint nonsworn, civilian persons to assist in the regulation of traffic.

The City Manager shall have the authority to appoint nonsworn, City employees or civilian volunteers pursuant to and in compliance with California Vehicle Code Section 21100(e) to regulate traffic whenever official traffic control devices are disabled or otherwise inoperable, at the scenes of accidents or disasters, or at such locations as may require traffic direction for orderly traffic flow. 10.04.016 Authority to appoint nonsworn, trained civilian volunteer to enforce disabled parking violations.

The City Manager shall have the authority to appoint nonsworn, trained volunteers to a special enforcement unit, pursuant to and in compliance with California Vehicle Code Section 22507.9 to enforce disabled parking violations under California Vehicle Code Sections 22507.8, 22511.7 and 22511.8. 10.04.020 Copies on file.

Three copies of Division 1 and Division 2 of Title 15 of the Los Angeles County Code shall be kept and maintained at all times in the office of the City Clerk for use and examination by the public. (Ord. 953 § 1, 1991)

10.04.030 Amendments.

The Palmdale vehicles and traffic code is amended by adding thereto the chapters set forth in PMC 10.04.031 through 10.04.150. (Ord. 1129 § 2, 1998; Ord. U-1129 § 3, 1998; Ord. 953 § 1, 1991)

10.04.031 Section 15.08.130 of Chapter 15.08 of Division 1 of Title 15 Los Angeles County Code amended.

Section 15.08.130 of Chapter 15.08 of Division 1 of Title 15 of the Los Angeles County Code is hereby amended to read as follows:

Section 15.08.130 Pedestrian.

(a) A “pedestrian” is any person who is afoot or who is using a means of conveyance propelled by human power other than a bicycle.

(b) “Pedestrian” shall include any person who is operating a self-propelled wheelchair, invalid tricycle, or motorized quadricycle and, by reason of physical disability, is otherwise unable to move about as a pedestrian, as specified in subdivision (a).

10.04.032 Section 15.08.040 of Chapter 15.08 of Division 1 of Title 15 Los Angeles County Code amended.

Section 15.08.040 of Chapter 15.08 of Division 1 of Title 15 of the Los Angeles County Code is amended to read as follows:

Section 15.08.040 Board.

“Board” shall mean the city council of the city of Palmdale.

10.04.033 Section 15.08.070 of Chapter 15.08 of Division 1 of Title 15 Los Angeles County Code amended.

Section 15.08.070 of Chapter 15.08 of Division 1 of Title 15 of the Los Angeles County Code is amended to read as follows:

Section 15.08.070 Commissioner.

“Commissioner” shall mean the city of Palmdale traffic engineer.

10.04.034 Section 15.64.010 of Chapter 15.64 of Division 1 of Title 15 Los Angeles County Code amended.

Section 15.64.010 of Chapter 15.64 of Division 1 of Title 15 of the Los Angeles County Code is amended to read as follows:

15.64.010 Signs limiting parking time authorized when.

Whenever the City Council finds by resolution that on any portion of the highway or of a private street or of any parking lot maintained or operated for the public by the City there is at any time lack of sufficient space to accommodate the operators of vehicles and that the time of parking should be limited so that everyone may have his fair turn, the City Council may direct the City Traffic Engineer to erect and maintain adequate signs along such portion of the highway, private street, or parking lot specifying the limitation on the time of parking. Such resolution of the City Council may be approved on the consent calendar portion of its agenda.

10.04.035 Section 15.64.200 of Chapter 15.64 of Division 1 of Title 15 Los Angeles County Code amended.

Section 15.64.200 of Chapter 15.64 of Division 1 of Title 15 of the Los Angeles County Code is amended to read as follows:

15.64.200 Vehicles parked over 72 hours – Removal by Code Enforcement Officer or Sheriff.

A. The sheriff or any regularly employed and salaried city employee, who is engaged in directing traffic or enforcing parking laws and regulations shall remove to a safe place every vehicle which has been parked or left standing upon a highway for 72 or more consecutive hours.

B. As used in this section, the words “safe place” include, but are not confined to, any garage, parking lot or open space owned by, maintained by or under the jurisdiction of the county of Los Angeles or the city of Palmdale, and also every privately owned garage the owner or proprietor of which will accept such vehicle.

10.04.040 Chapter 15.101 added – Commercial vehicle parking restrictions in residential or agricultural zones.

Chapter 15.101 is added to read as follows:

Chapter 15.101

A person shall not park any commercial vehicle having a manufacturer’s gross vehicle weight rating of 10,000 pounds or more on any highway or alley at anytime in any residential or agricultural zone as defined in Ordinance No. 140, entitled “The Zoning Ordinance.” It is not a violation of this chapter to park said vehicles in residential or agricultural zones when such vehicles are involved in:

A. Necessary loading and unloading;

B. Performing a service activity on the adjacent lot or parcel of land;

C. A lawful commercial use on the adjacent lot or parcel of land;

D. The construction of buildings or structures on the adjacent lot or parcel of land; or

E. The construction or maintenance of a street, alley, parkway or highway.

10.04.050 Chapter 15.102 added – Prohibition of certain vehicles except on designated routes.

Chapter 15.102 is added to read as follows:

Chapter 15.102

A. Except as provided in subparagraph B hereof, any commercial vehicle exceeding a manufacturer’s gross vehicle weight rating of 10,000 pounds is hereby prohibited from using any streets in the city other than those designated in Chapter 15.103 which have been marked by appropriate signs. All streets in the city not designated in Chapter 15.103 shall be restricted streets for the purpose of this Chapter 15.102.

B. Notwithstanding subparagraph A above, nothing herein shall be deemed to prohibit any such commercial vehicle from entering upon a restricted street from an unrestricted street, by use of the shortest and most direct route, when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street, or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted street for which a building permit has previously been obtained.

10.04.060 Chapter 15.103 added – Truck routes designated.

Chapter 15.103 is added to read as follows:

Commercial vehicles having a manufacturer’s gross vehicle weight rating of 10,000 pounds or more shall use the following streets or portions of streets within the city limits except as provided in Section 15.102.B:

A. 10th Street West from Avenue P to Avenue M.

B. Sierra Highway from the Antelope Valley Freeway to Avenue M.

C. 50th Street East from Palmdale Boulevard to Avenue M.

D. Avenue M from the Antelope Valley Freeway to 50th Street East.

E. Avenue P from 10th Street West to 50th Street East.

F. City Ranch Road, Tierra Subida, Rayburn Road, and Avenue R from the Palmdale Dump to Sierra Highway.

G. Avenue S from Antelope Valley Freeway to Sierra Highway.

H. Pearblossom Highway from Sierra Highway to Fort Tejon Road.

I. Avenue T from Fort Tejon Road to 90th Street East.

10.04.070 Chapter 15.104 added – Traffic and fire access lanes designated.

Chapter 15.104 is added to read as follows:

Chapter 15.104

The driveways, passageways and circulation routes within a public parking area, serving commercial or industrial uses as stipulated in Ordinance 140, the Zoning Ordinance of the city, whether publicly or privately owned, are designated as traffic and fire access lanes.

10.04.080 Chapter 15.105 added – Parking in traffic and fire access lanes.

Chapter 15.105 is added to read as follows:

Chapter 15.105

When appropriate signs are posted or painted thereon pursuant to California Vehicle Code, Section 22500.1, no person shall stand or park a vehicle within any traffic or fire access lane, and all provisions of the Vehicles and Traffic Code may be enforced with regard thereto.

10.04.090 Chapter 15.106 added – Transporting dogs in open vehicles.

Chapter 15.106 is added to read as follows:

Chapter 15.106

A. No person shall transport any dog in or on the back of any open truck or other open vehicle while traveling on any road, street, highway, lane or alley in the city.

B. Subparagraph A above shall not apply to any person who transports a dog in any open truck or other open vehicle which is partially enclosed by stakes, or other similar devices which rise at least two feet, nine inches above the tops of the sides and back of the vehicle and which are designed to prevent the dog from falling or escaping from the vehicle.

10.04.100 Chapter 15.107 added – Regulation of speed bumps on private streets, easements and fire lanes.

Chapter 15.107 is added to read as follows:

Chapter 15.107

A. Declaration of Policy. It is hereby declared to be the policy of the city to prohibit the installation of new speed bumps on private streets, easements or fire lanes, as such vehicle speed control devices may obstruct convenient and timely emergency vehicle access or otherwise jeopardize the public health, safety and general welfare.

B. Definitions. For the purpose of this chapter, the following words shall have the meaning herein specified:

1. “Existing Speed Bump” shall mean any speed bump or similar traffic control device now existing which limits or otherwise controls the flow or speed of vehicular traffic.

2. “Traffic Control Review Committee” or “Review Committee” shall mean a committee comprised of the following individuals or their designees: Fire Marshall, Sheriff, Director of Public Works and Director of Planning.

3. “Private Street” shall mean any street access way which is not dedicated for public use.

4. “Private Fire Lane” shall mean any street or access way which is reserved in recorded documents for fire protection access or reserved as a condition of occupancy of a structure or structures and which is not dedicated for public use.

5. “Private Easement” shall mean any easement or access way reserved for vehicular access and which is not dedicated for public use.

C. Existing Speed Bumps. Speed bumps on private streets, easements or fire lanes, existing as of the effective date of this chapter, may not be reconstructed, replaced or otherwise altered without the express written authorization of the Review Committee.

D. Removal of Existing Speed Bumps. Existing speed bumps which are determined by the Review Committee to obstruct convenient and timely emergency vehicle access or in any other manner to jeopardize the public health, safety and welfare may be declared a public nuisance and shall be removed within a period of time determined to be reasonable by the Review Committee.

E. Exceptions. The Review Committee may grant exceptions to provisions of this chapter when:

1. The applicant has demonstrated to the satisfaction of the Review Committee that alternative means for limiting or controlling the flow or speed of vehicular traffic are unwarranted or infeasible; and

2. A speed bump design is proposed which, relative to height, width, composition, spacing, and such other information as may be requested, is determined by the Review Committee not to jeopardize the public health, safety and welfare.

F. Appeal to City Council. Determinations of the Review Committee shall be subject to appeal to the City Council.

10.04.110 Chapter 15.108 added – Speed limits designated.

Chapter 15.108

A. As authorized by the California Vehicle Code (CVC), it is hereby determined upon the basis of engineering and traffic surveys that the maximum speeds (in miles per hour) on the following streets are as identified in subsection C. Speed limits established pursuant to this Chapter shall be effective when appropriate signs giving notice thereof are erected upon said street.

B. Definitions. For the purpose of this chapter, the following words shall have the meaning here-in specified:

1. “Interim” – shall mean a time period from the signing of an engineering and traffic survey and the posting of appropriate signage to the legal statute as determined by the CVC or until this section is amended.

2. “New Street Segment” – shall mean any public road opened to the public, accepted for public maintenance, subsequent to adoption of the ordinance codified in this section.

3. “Substantially Modified” – shall mean any public road that has been modified to provide an additional lane or median, has changed in classification, or has been extended beyond its previous limits.

10.04.120 Chapter 15.109 added – Regulation of vending and solicitation in public rights-of-way, on public property, and in privately owned off-street parking facilities.

Chapter 15.109 is added to read as follows:

Chapter 15.109

A. Definition. For the purposes of this chapter, the following words have the following meanings:

1. “Business” means to provide, or offer to provide, any type of merchandise, or to perform or offer to perform, any type of service, in exchange for money, labor, goods, or any other form of consideration which will be received for other than a charitable purpose.

2. “Commercial vehicle” has the same meaning as defined in Section 260(a) of the California Vehicle Code.

3. “Employment” means any services, industry or labor performed, or offered to be performed, by a person in consideration for wages or other compensation, or under any contract of hire, whether written or oral, express or implied.

4. “Public right-of-way” means, without limitation, public streets, highways, sidewalks, and driveways.

5. “Solicit,” or any of its derivatives, means any request, offer, enticement, or other action which announces or informs of the availability for employment, the presence of merchandise for sale or purchase, or which constitutes an appeal for a contribution of money or other property. A solicitation is deemed complete when made, regardless of whether an employment relationship is created, a business transaction is consummated, or a contribution of money or other property is made or received.

6. “Vending” means peddling, selling, hawking, or delivering, or soliciting for sale, whether at retail or wholesale, any merchandise, including but not limited to food or beverages for human consumption, from a pack, basket or commercial vehicle.

B. Prohibition of Vending and Solicitation in the Public Right-of-Way.

1. It is unlawful for any person to stand in any portion of the public right-of-way while vending, or attempting to vend, any merchandise to any person traveling in a motor vehicle located on or within a public right-of-way, or while soliciting, or attempting to solicit, any employment, business transaction, or contributions of money or other property from any person traveling in a motor vehicle located on or within a public right-of-way.

2. It is unlawful for any person, while the occupant of any motor vehicle, to engage in vending, or to solicit or attempt to solicit any employment, business transaction, or contribution of money or other property

from a person who is on or within a public right-of-way.

C. Vending from Commercial Vehicles in Residential Zones – Restrictions.

Unless otherwise prohibited by Chapter 15.101 or 15.102, the driver of any commercial vehicle engaged in vending upon a street may vend products on a street in a residential zone only after bringing the commercial vehicle to a complete stop and parking it in a lawful manner, adjacent to the curb, and not less than fifty (50) feet from any intersection of two or more streets.

D. Vending from Commercial Vehicles in All Zones of the City – Time Limitations.

It is unlawful for any person engaged in the business of selling or distributing any food, beverages, goods, wares, or merchandise from a commercial vehicle to allow the commercial vehicle to remain at any one location on a public street for a period of time exceeding thirty (30) minutes and, regardless of the length of time that vending occurred at that location, to vend again within five hundred (500) feet of that location within a period of four (4) hours.

E. Prohibition of Solicitation in Unauthorized Locations within Privately-Owned Offstreet Parking Facilities.

1. It is unlawful for any person to solicit or attempt to solicit employment, business, or contributions of money or other property from any location within a privately-owned offstreet parking facility, other than a location within or served by that parking facility which is authorized for such solicitations by the property owner or the property owner’s designated representative. This prohibition does not apply to a solicitation of the owner or lawful tenants of any adjacent building or structure for employment or for a business transaction.

2. The term “privately-owned offstreet parking facility” means privately-owned property in a commercial or industrial zone which is generally held open for use of the public for purposes of vehicular parking and where no fee is charged for the privilege to park.

3. The prohibitions contained in subsection 1 apply only to privately-owned offstreet parking facilities where the following occur:

a. The owner or operator of the offstreet parking facility establishes a written policy which designates a specific area for the lawful solicitation of employment, business, or contributions of money or other property, which area is in a location accessible to the public and does not interfere with the normal business operations within any adjacent commercial or industrial buildings or structures; and

b. A copy of that written policy is submitted to the City Manager to be maintained in City files; and

c. The owner or operator of the offstreet parking facility has caused to be posted in a conspicuous place at each entrance to

that offstreet parking facility a notice, not less than eighteen (18) inches by twenty-four (24) inches in size, with lettering not less than one (1) inch in height, which notice is in substantially the following form:

“It is a misdemeanor to engage in the solicitation of employment, business, or contributions of money or other property in any area of this parking facility which is not approved for that activity by the owner.”

10.04.130 Chapter 15.110 added – Enforcement of vehicle and traffic laws in designated mobile home parks.

Chapter 15.110 is added to read as follows:

Chapter 15.110

A. Designated Parks. For purposes of this Chapter, the term “Designated Parks” shall mean the following mobilehome parks:

1. The mobilehome park located at 40701 Rancho Vista Boulevard, in the general vicinity of Rancho Vista Boulevard and Avenue N-8, commonly known as “Boulders l” or “Boulders at the Ranch I.”

2. The mobilehome park located at 5200 Entrar Drive, in the general vicinity of Entrar Drive and Avenue N-8, commonly known as “Boulders II” or “Boulders at the Ranch II.”

3. The mobilehome park located at 1030 East Avenue S, in the general vicinity of Avenue S and 10th Street East, commonly known as “Boulders at the Lake.”

4. The mobilehome park located at 3524 East Avenue R, in the general vicinity of the southeast corner of the intersection of Avenue R and 35th Street East, commonly known as “Sagetree Village.”

5. The mobilehome park located at 3255 East Avenue R, in the general vicinity of the northwest corner of the intersection of R and 35th Street East, commonly known as Mountain View Estates.

6. The mobilehome park located at 38015 65th Street East, in the general vicinity of Avenue R and 65th Street East, commonly known as Palmdale Mobilehome Park.

Any change in the name by which a mobilehome park is commonly known subsequent to the adoption of this chapter shall not be deemed to invalidate nor impede enforcement of this chapter.

B. The provisions of the California Vehicle Code shall apply to the roads within the mobilehome parks enumerated in paragraph A, above, and may be enforced; and as authorized by Chapter 9 of Division 11 of the California Vehicle Code, Section 22500 et seq., local City of Palmdale ordinances prohibiting, restricting or regulating the parking, stopping or standing of vehicles as set forth in Divisions 1 and 2 of Title 15 of the Los Angeles County Code, as adopted and amended as the Palmdale Vehicles and Traffic Code by Palmdale Municipal Code Section 10.04.010, shall apply to the roads and may be enforced as well. Notwithstanding the foregoing, the roads shall remain privately owned and maintained, and the City of Palmdale assumes no obligation to maintain them, nor to provide patrol or traffic enforcement services for the enforcement of the California Vehicle Code or Palmdale Vehicles and Traffic Code. The Los Angeles Sheriffs Department shall be authorized to enforce the California Vehicle Code and the Palmdale Vehicles and Traffic Code on those roads. City of Palmdale Traffic Enforcement Officers shall be authorized to enforce the Palmdale Vehicle and Traffic code and those provisions of the California Vehicle Code related to the stopping, standing, or parking of vehicles.

C. Speed Limit. The prima facie speed limit on any road within a Designated Park shall be 15 miles per hour.

D. Posting of Signs Required. This chapter shall not apply to a mobilehome park which does not have posted at the time of citation the following signs:

1. Signs approved by the Director of Planning at the entrances to the mobilehome park of the size, shape, and color as to be readily legible during the daylight hours from a distance of 100 feet, stating that the roads within the park or community are subject to the provisions of the California Vehicle Code and the Palmdale Vehicles and Traffic Code; and

2. Traffic signs, marking, and devices upon the private roads within the Designated Park that conform to the uniform standards and specifications adopted by the California Department of Transportation pursuant to California Vehicle Code Section 21400, including but not limited to speed limit signs.

10.04.140 Chapter 15.120 added – Enforcement of California Vehicle Code provisions on private roads and off-street parking facilities of the Antelope Valley Mall.

Chapter 15.120 is added to read as follows:

15.120.010 Enforcement of the California Vehicle Code to the Private Roadways Serving the Antelope Valley Mall.

A. Findings and Intent. Pursuant to California Vehicle Code Section 21107.6, the City Council finds and declares as follows:

1. There are privately owned and maintained roadways (“Roadways”) serving the Antelope Valley Mall which are generally held open to the public for purposes of vehicular travel to serve its commercial establishments. These Roadways are bounded generally to the north by West Avenue O-8, thence to the northeast by the Antelope Valley Freeway, State Route 14, thence to Tenth Street West on the east, thence to Rancho Vista Boulevard (Avenue P) on the south, thence to Fifteenth Street West on the west. These Roadways are further identified as Mall Ring Road, and the Antelope Valley Mall Driveways intersecting the aforementioned public streets, excluding State Route 14, and including Antelope Valley Mall Driveway West and Antelope Valley Mall Driveway East intersecting Rancho Vista Boulevard (Avenue P).

2. It is the intent of the City Council that the provisions of the California Vehicle Code shall apply to the Roadways and that said code may be enforced thereon. In so doing, the Roadways remain privately owned and maintained, and the City of Palmdale assumes no obligation to maintain them, nor to provide patrol or traffic enforcement services for the enforcement of the California Vehicle Code thereon.

3. Prior to adopting this ordinance, the City Council held a public hearing upon ten (10) days prior notice to the owners of the Roadways and of the land on which the Antelope Valley Mall is located.

B. Prohibition of Violating the California Vehicle Code on Antelope Valley Mall Roadways. The provisions of the California Vehicle Code shall apply to the Roadways serving the Antelope Valley Mall identified in paragraph 1 of subdivision A of this section. It shall be a violation of the California Vehicle Code to violate any provisions on any Roadway serving the Antelope Valley Mall.

C. Defense to Prosecution under this Section. Notwithstanding subdivision B of this section, the ordinance codified in this section shall not apply to any Roadway on which the owner or operator has caused to be erected a notice of such size, shape, and color as to be readily legible during daylight hours from a distance of 100 feet, to the effect that the Roadway is privately owned and maintained and that it is not subject to public traffic regulations or control. It shall be a defense to any prosecution under subdivision B of this section that a Roadway has been so posted.

D. No Obligation to Maintain or Enforce. The Antelope Valley Mall Roadways remain privately owned and maintained. The City of Palmdale assumes no obligation to maintain them, nor to provide patrol or traffic enforcement services for the enforcement of the California Vehicle Code thereon.

15.120.020 Enforcement of Certain Provisions of the California Vehicle Code to Antelope Valley Mall Parking Lots.

A. Findings and Intent. Pursuant to California Vehicle Code Section 21107.8, the City Council finds and declares as follows:

1. There are privately owned and maintained offstreet parking facilities serving the Antelope Valley Mall (“Antelope Valley Mall Parking Lots”) that are generally held open for use of the public for purposes of vehicular parking. The Antelope Valley Mall is bounded generally to the north by West Avenue O-8, thence to the northeast by the Antelope Valley Freeway, State Route 14, thence to Tenth Street West on the east, thence to Rancho Vista Boulevard (Avenue P) on the south, thence to Fifteenth Street West on the west.

2. It is the intent of the City Council that Sections 22350, 23103, and 23109 and the provisions of Division 16.5 (commencing with Section 38000) of the California Vehicle Code shall not apply to the Antelope Valley Mall Parking Lots unless its owner or operator has caused to be posted in a conspicuous place at each entrance to the Antelope Valley Mall Parking Lots a notice not less than 17 by 22 inches in size with lettering not less than one inch in height to the effect that the Antelope Valley Mall is subject to public traffic regulations and control. In adopting the ordinance codified in this section, the Antelope Valley Mall Parking Lots remain privately owned and maintained and the City of Palmdale assumes no obligation to maintain them, nor to provide patrol or traffic enforcement for the enforcement of the California Vehicle Code thereon.

3. Prior to adopting the ordinance codified in this section, the City Council held a public hearing upon ten (10) days’ prior written notice to the owners of the land on which the Antelope Valley Mall Parking Lots are located and to the operator of the Antelope Valley Mall.

B. Prohibition Against Violating Certain Provisions of the California Vehicle Code in Antelope Valley Mall Parking Lots. Sections 22350, 23103, and 23109 and the provisions of Division 16.5 (commencing with Section 38000) of the California Vehicle Code shall apply to the Antelope Valley Mall Parking Lots identified in paragraph 1 of subdivision A of this section. It shall be a violation of those provisions to violate them in any Antelope Valley Mall Parking Lot. This section shall not apply to an Antelope Valley Mall Parking Lot unless the owner or operator has caused to be posted in a conspicuous place at each entrance to that parking lot a notice not less than 17 inches by 22 inches in size with lettering not less than one inch in height, to the effect that the parking lot is subject to traffic regulations and control.

C. No Obligation to Maintain or Enforce. The Antelope Valley Mall Parking Lots remain privately owned and maintained. The City of Palmdale assumes no obligation to maintain them, nor to provide patrol or traffic enforcement services for the enforcement of the California Vehicle Code thereon.

10.04.150 Chapter 15.130 added – Prohibiting the parking of recreational vehicles in residential districts for more than 72 hours.

Chapter 15.130 is added to read as follows:

Chapter 15.130

A. No person shall park or leave standing within any residential zone any recreational vehicle, trailer, boat, or camper for a period of 72 or more consecutive hours upon any highway, street, alley, or publicly owned property.

B. For the purpose of this chapter, a recreational vehicle, trailer, boat, or camper shall be deemed to have been left standing when it has not been moved more than 1 block or 300 feet, whichever is greater, from its original stopped position. When parked or left standing on a highway, street, or alley, distance in feet shall be measured from the either lot line or boundary of the lot abutting its original stopped position.

10.04.160 Chapter 15.140 added – Electric vehicle parking.

Chapter 15.140 is added to read as follows:

Chapter 15.140 Electric Vehicle Parking

15.140.010 Definitions: For the purposes of this chapter:

A. “Charging” means the time during which the Electric Car is connected to the Electric Vehicle Charging Station and electrical power is being transferred for the purpose of recharging the Electric Vehicle’s onboard batteries.

B. “Electric Vehicle” shall mean a vehicle powered entirely by electricity stored in an onboard battery or a hybrid electric vehicle that is primarily powered by electricity stored in an onboard battery. Electric Vehicle does not include hybrid vehicles that are primarily powered by gasoline or those vehicles incapable of having their onboard batteries charged at an Electric Vehicle Charging Station.

C. “Electric Vehicle Charging Station” shall mean a parking space or stall equipped with a charger designed to transfer electricity to an Electric Vehicle’s onboard battery.

15.140.020 Electric Vehicle Parking Regulations. No person shall park or cause to be parked or allow to remain standing any vehicle at an Electric Vehicle Charging Station located on any street or in any parking facility, unless the vehicle is an Electric Vehicle, is Charging, and has not exceeded any applicable parking time limit posted at the Electric Vehicle Charging Station.
