COMMUNITY DEVELOPMENT COMMISSION
2.40.010 Need for community development commission.
In accordance with the terms and provisions of Part 1.7 of Division 24 of the Health and Safety Code of the state of California, the city council declares that there is a need for a community development commission to function in the city of Petaluma. (Ord. 1201 NCS §1 (part), 1975.)
2.40.020 Name.
The commission shall be known as the "Petaluma community development commission." (Ord. 1201 NCS §1 (part), 1975.)
2.40.030 Purpose.
The Petaluma community development commission is created and established in order that the redevelopment agency and the housing authority heretofore established in the city may be operated and governed under a single operating entity and board. The Petaluma community development commission is also created and established for the purpose of exercising such other powers regarding community development which the city council may desire to delegate to the commission subject to such conditions as may be imposed by the city council. 2.40.040 Commission shall be city council.
The council hereby declares itself to be the Petaluma community development commission and all the rights, powers, duties, privileges and immunities set forth in Part 1.7 of Division 24 of the Health and Safety Code of the state of California are vested in the city council. 2.40.050 Nature, power, authority, functions and jurisdiction of the commission.
The nature, power, authority, functions and jurisdiction of the Petaluma community development commission shall include, but shall not be limited to, all of the nature, power, authority, functions and jurisdiction of the redevelopment agency and the housing authority. The Petaluma community development commission shall also have the nature, power, authority, functions and jurisdiction relating to community development as may be delegated to the commission by the city council, subject to such conditions as may be imposed by the city council. 2.40.060 Redevelopment and housing authority funds not to be commingled.
In carrying out its functions under the California Community Redevelopment law heretofore performed by the redevelopment agency, and in carrying out its functions under the California Housing Authority law heretofore performed by the housing authority, the Petaluma community development commission shall maintain separate books of account and shall not commingle funds which have been specifically designated for either the redevelopment or housing authority function. 2.40.070 Effect of invalidity or referendum.
In the event all or any portion of this chapter shall be declared invalid or in the event this chapter should be revoked by referendum, it is the intention of the city council that the existing redevelopment agency and the housing authority shall continue and remain in full force and effect.
