9.30.010 Purpose and intent.
The city council of San Jacinto finds, determines and declares that this chapter has been enacted upon the following facts and purposes:
A. The events of Halloween could put children unknowingly in close proximity to sexual offenders who may have no legal restrictions regarding such proximity to children; and
B. Sex offenders pose an immediate threat around Halloween to the public health, safety and welfare because youth often will engage a disproportionate number of complete strangers when door-to-door canvassing different neighborhoods as part of the traditional Halloween activities.
C. Sex offenders often target areas or events that attract large numbers of children such as schools and parks.
D. Halloween events, particularly the door-to-door solicitation of candy, creates the potential for many encounters with registered sex offenders. (Ord. 10-09 § 3 (part))
9.30.020 Definitions.
For the purposes of this chapter the following definitions shall apply:
A. “Child” or “children” means any person(s) under the age of eighteen (18) years of age.
B. “Sex offender” means any person who is required to register as a sex offender pursuant to Section 290 of the California Penal Code, regardless of whether that person is on parole or probation, and has been convicted of an offense against a child. (Ord. 10-09 § 3 (part))
9.30.030 Time, place, and manner restrictions.
All registered sex offenders, between twelve a.m. and eleven fifty-nine p.m. on October 31st shall:
A. Leave all exterior residential, decorative and ornamental lighting off during the evening hours starting at five p.m. until eleven fifty-nine p.m. on October 31st; and
B. Be prohibited from decorating his or her residence with Halloween decorations, and shall remove any such decorations; and
C. Be prohibited from answering the door to children who are trick-or-treating. (Ord. 10-09 § 3 (part))
