10.25.010 Violations – Civil penalties.

The provisions of this chapter are intended to implement the requirements for a civil appeal procedure for parking, stopping, or standing vehicle violations mandated by 1992 Assembly Bill AB 408 (codified into California Vehicle Code Section 40200 et seq.). Vehicle parking, stopping, or standing violations of this title are civil violations to be handled by issuance of a citation followed by an administrative process provided in this chapter. Also, pursuant to Vehicle Code Section 40225, an equipment violation entered on the notice of a vehicle parking, stopping, or standing violation shall be processed as provided herein. 10.25.020 City to set penalties.

Penalties for violation of vehicle parking, stopping, or standing regulations shall be set and periodically reviewed by resolution of the City Council. (Ord. 1650 § 1, 7-13-93. Formerly § 17-151).

10.25.030 Collection of penalties.

Penalties shall be collected by the City or a private agency with which the City may contract. (Ord. 1650 § 1, 7-13-93. Formerly § 17-152).

10.25.040 Hearing process.

Any appeal of a citation by an interested party under this chapter may be made by complying with the provisions of Vehicle Code Section 40200 et seq. For the convenience of interested parties, a flow chart describing the process, time for requests, and money deposits (if necessary) will be made available to the public and a copy maintained at the Police Department's and City Clerk's respective offices. Pursuant to Vehicle Code Section 40215, the City Manager is delegated the authority to designate a hearing examiner. This delegated authority specifically permits the City Manager to designate the City Attorney's office as hearing examiner. The administrative hearings will comply with Vehicle Code Section 40215. Rules for the conduct of the hearing before the examiner shall be adopted by resolution of the City Council. (Ord. 1650 § 1, 7-13-93. Formerly § 17-153).

10.25.050 Required deposits.

Deposits required by Vehicle Code Section 40200 et seq. shall be made as directed by City policy. (Ord. 1650 § 1, 7-13-93. Formerly § 17-154).

10.25.060 Appeal process to the municipal court.

Pursuant to Vehicle Code Section 40230, as amended, if the contestant is not satisfied with the decision rendered in the administrative hearing process, he may, after the mailing of, or personal delivery of, the final administrative decision, seek review of the decision in the municipal court.
