ARTICLE I. IN GENERAL

25.1 Definitions.

Wherever the words “private patrol” or “patrol system” are used in this chapter, they shall mean any private service or system which purports to furnish or does furnish to members or subscribers any watchman or guard, whether uniformed or otherwise to patrol any part of the incorporated limits of the city or to guard or watch any property, including guarding against fire, theft or both, or to perform any service usually and customarily performed by the police department.

The words “private patrol” or “patrol system” do not include the guarding of property of a single owner while such property is not open to the public nor do they include one or more individuals whose entire salary or wage is paid by such owner, irrespective of whether such salary or wage is paid directly to the individuals performing such guard duty or to another, nor do they include service of any nature performed by an employee whose main or principal duty is not that of guarding or protecting property.

The word “patrolman” means an individual engaged in the act of guarding property as the owner, member or employee of a patrol system. (Ord. No. 1073, §§ 2 to 4.)

25.2 Conduct of patrolmen generally.

No patrolman shall either by himself or through the actions of another, harass, annoy or commit a nuisance against or injure the property of, or unnecessarily enter or otherwise trespass upon the property of any person whose property the patrol system of such patrolman is not employed to protect. (Ord. No. 1073, § 33.)

25.3 Performance of police duties for general public.

No patrolman or patrol system shall undertake to perform on behalf of the general public the duties of any regularly constituted police department or police officer. Nothing herein contained shall be deemed to restrict any patrolman or patrol system from making any investigation incidental to the theft, loss, embezzlement, misappropriation or concealment of any property which he or it has been hired or engaged to protect, guard or watch. 25.4 Marking and accessories of cars generally.

No car used by a patrol system or patrolman shall be marked or equipped with accessories in such a manner as to resemble a police car used by the city. (Ord. No. 1073, § 38.)

25.5 Use of radio receivers.

A patrol system or a patrolman employed by a patrol system may have a radio receiving police calls in his car, and may subscribe to radio telephone services as provided by the public communications system in the city or county, but if there is any abuse in the use of such radio receiving set, it shall be a cause of revocation of any license issued under this chapter. (Ord. No. 1073, § 38.)

25.6 Cars not to have red lights or sirens.

No car used by a patrol system or patrolman shall be equipped with a red light or siren. (Ord. No. 1073, § 38.)

25.7 Equipment of patrolmen.

The city manager shall specify the police equipment, including weapons, which a patrolman may wear while on duty. A patrolman may not wear any equipment or carry any weapon not so specified. However, nothing herein contained shall be deemed to prohibit a patrolman from carrying a gun pursuant to a permit from any duly constituted authority. (Ord. No. 1073, § 35.)

25.8 Police rank and title not to be used.

A patrolman shall not assume or use a rank or title the same as or similar to any rank or title used by the sheriff or by any police department within the county, nor shall a patrol system use, grant or bestow or permit any patrolman to assume any such rank or title. (Ord. No. 1073, §§ 31, 32.)

25.9 Patrolman’s uniform.

A patrolman shall be required to wear a military uniform and cap. Such uniform shall not be of such appearance as to be readily mistaken for an official sheriff’s uniform or an official police uniform of the police force of any city within the county or an official uniform of any state police officer. 25.10 Patrolman’s badge—Issuance.

At the time a patrolman’s license is issued as provided in this chapter, the person receiving such license shall be issued a patrolman’s badge. (Ord. No. 1073, § 23.)

25.11 Same—Size, design, etc.

The city manager shall prescribe the size, shape of and inscription upon the badge to be worn by patrolmen. The design shall be such as not to be readily mistaken as an official state or county badge, sheriff’s badge, marshal’s badge or official police badge of any city within the county or of any state officer. (Ord. No. 1073, § 23.)

25.12 Same—Not to be given to private person.

No person shall give, deliver to or sell any patrolman’s badge or any badge of a design the same as, or so similar to, the patrolman’s badge as to be mistaken therefor, to any private person. (Ord. No. 1073, § 28.)

25.13 Same—Not to be purchased, received as pledge, etc.

No person shall purchase or receive as a gift, pawn or pledge any patrolman’s badge. (Ord. No. 1073, § 29.)

25.14 Same—To be worn.

While engaged in his duties as such, a patrolman shall wear the badge prescribed by the city manager and shall wear no other badge of any kind, character or description, except a badge issued to him by lawful governmental authority. (Ord. No. 1073, § 25.)

25.15 Same—Surrender to employer.

A patrolman shall turn in his badge to his employer when he ceases to be employed as a patrolman. (Ord. No. 1073, § 24.)

25.16 Reports to police.

Every patrol system operator and patrolman shall make, without unnecessary delay, a report to the police department of all violations of this Code and other city ordinances and of state or federal law which come to his attention; provided, however, that this section shall not apply to traffic and other minor violations. (Ord. No. 1073, § 36.)

25.17 Complaints against patrol system or patrolman.

All complaints regarding the activities of a patrol system or of a patrolman employed by a patrol system shall be investigated by the chief of police followed by a written report to the city manager. Reports of such complaints shall be held in the police files and shall be subject to inspection of the city council at all times. Notice of any such complaint shall be given to the patrol system operator and the patrolman affected thereby and they shall have the right to examine and reply to any such complaint. (Ord. 25.18 Rules and regulations of city manager.

The city manager may make rules and regulations not inconsistent with this chapter governing patrol systems and patrolmen. (Ord. No. 1073, § 39.)

ARTICLE II. PATROL SYSTEM REGISTRATION

25.19 Patrol systems; registration required.

Every person, partnership or corporation system doing business within the city boundaries shall register his or her name and file a copy of his or her state identification card with the chief of police. Registration shall be completed within thirty days of the commencement of business within the city boundaries or within thirty days of the effective date of this section, whichever is later. Any change of name, change in corporate or partnership status, change of status as a patrol system or change in status with regard to the state identification card shall be reported to the chief of police within one week of the change. 25.20 Patrol officers; registration required.

Every patrol officer employed by a patrol system required to register with the chief of police pursuant to section 25.19 shall register his or her name and file a copy of his or her state identification card with the city manager. Registration shall be completed within thirty days of the commencement of employment as a patrol officer or within thirty days of the effective date of this section, whichever is later. Any change of name, change in employment status or change in status with regard to the state identification card shall be reported to the chief of police within one week of the change. (Ord.
