DANGEROUS CHEMICALS

ARTICLE 1 - GENERAL

86.1.1 ADOPTION OF I.C.C. REGULATIONS.

Part 72 of the regulations of the Interstate Commerce Commission of the United States of America entitled, "Commodity list of explosives and other dangerous articles containing the shipping name or description of all articles subject to parts 71-78" as published by the American Trucking Association, Inc., in the Motor Carriers’ Explosives and Dangerous Articles Tariff 11, issued July 18, 1962, effective October 3, 1962 and Supplement L thereto issued December 4, 1962, effective February 17, 1963, are hereby adopted by this reference and incorporated into this Chapter as a part hereof.

86.1.2 EXCLUSIONS.

This Chapter shall not apply so as to prohibit or regulate:

a)    Any activity prohibited or regulated in Division 11 of the Health and Safety Code of the State of California.

b)    The shipping or other transportation of explosives and dangerous articles regulated by the Interstate Commerce Commission.

c)    Any activity of the United States, the State or any subdivision or agency thereof, except public schools.

d)    The storage or sale of combustible fuels or any other products or goods regulated by the Fire Prevention Code of the City.

86.1.3 POISONOUS GASES; USE IN REFRIGERATORS, ETC.

It shall be unlawful for any person to use, sell, rent or install any refrigerating or cooling device, or any other device using methyl chloride gas or other nonodorous poisonous gas in the operation of same, unless there be mixed with such gas at all times, a sufficient amount of harmless odorous gas or substance, so that any escape of such poisonous gas in such quantities as will endanger life or health will be accompanied by the escape of sufficient amount of such harmless odorous gas as will be noticeable to the senses of persons in the same room or in the vicinity of such machine or device.

ARTICLE 3 - HAZARDOUS MATERIALS

86.3.1 UNDERGROUND STORAGE OF HAZARDOUS SUBSTANCES.

a)    Pursuant to the provisions of the California Health and Safety Code, Chapter 6.7, Division 20, commencing at Section 25280, and as it may be amended, the Fire Department of the City is designated as the agency for administering and enforcing the provisions of said Chapter 6.7.

b)    In order to implement said chapter, the Fire Chief shall:

1)    Enforce and administer the provisions of said chapter, all federal laws which are applicable, and regulations of the State Water Resources Control Board, or the Regional Water Quality Control Board which are applicable; and

2)    Prepare supplemental regulations from time to time to facilitate such enforcement and administration, as permitted by such Chapter 6.7.

c)    This Section is an amendment of, and continuation of, Ordinance 3083 adopted December 20, 1983.

86.3.2 HAZARDOUS MATERIALS RELEASE RESPONSE PLANS AND INVENTORY.

a)    Pursuant to the provisions of the California Health and Safety Code, Chapter 6.95, Division 20, commencing at Section 25500, and as it may be amended, the Fire Department of the City is designated as the agency for administering and enforcing the provisions of said Chapter 6.95.

b)    In order to implement said Chapter 6.95, the Fire Chief shall:

1)    Enforce and administer the provisions of said Chapter 6.95, all federal regulations which are applicable and all regulations of the State Water Resources Control Board and the Regional Water Quality Control Board which are applicable; and

2)    Prepare supplemental regulations from time to time to facilitate such enforcement and administration, as permitted by said Chapter 6.95.

c)    This Section is an amendment of, and continuation of, Ordinance 3161 adopted on January 21, 1986.

d)    Any person who violates the provisions of Section 25507 of the Health and Safety Code shall be subject to the penalties provided in Section 25515 of the Health and Safety Code.
