12.20.010 Intent.

It is the intent of this chapter to establish those minimal regulations that will ensure maximum enjoyment of Trinidad’s trail system by the public, while at the same time protecting the environment. [Ord. 2008-02, 2008; Ord. 2004-02, 2004].

12.20.020 Description of trail system.

The Trinidad general plan establishes a system of public trails throughout the city. The Trinidad planning commission and Trinidad city council establish criteria for siting, marking, and maintaining public trails, including benches at scenic locations. [Ord. 2008-02, 2008; Ord. 2004-02, 2004].

12.20.030 Regulations – Administrative.

The Trinidad city council may adopt policies, rules and regulations regarding trails as it deems appropriate from time to time by Trinidad city council resolutions or other actions. [Ord. 2008-02, 2008; Ord. 2004-02, 2004].

12.20.040 Restricted use for Old Wagon Road Trail.

Public use of the Old Wagon Road Trail (also known as the Wagner Street Trail) shall be restricted as follows:

A. Use during daylight hours only (from the time of sunrise to sunset);

B. Use by pedestrians only;

C. Dogs are prohibited (see TMC 6.06.010);

D. Interference with the public’s right of use and quiet enjoyment is prohibited. [Ord. 2008-02, 2008; Ord. 2004-02, 2004].

12.20.050 Violation – Penalty.

A violation of any of the provisions of this chapter shall be either an infraction or a misdemeanor. Each violation is punishable by penalties as authorized by Government Code Section 36901.

Violations charged as infractions are punishable by fines as follows, TMC 1.08.010(C) notwithstanding:

A. A fine not exceeding $150.00 for the first violation;

B. A fine not exceeding $300.00 for a second violation within one year; and

C. A fine not exceeding $750.00 for a third violation within one year.

Violations charged as misdemeanors are punishable pursuant to the provisions of TMC 1.08.010(B). [Ord. 2008-02, 2008; Ord. 2004-02, 2004].
