1.01.010 Adoption.

The compilation and codification of the existing ordinances of the West County Wastewater District that is on file in the office of the administration supervisor to the board of the district under the title of “West County Wastewater District Code” (hereinafter the “West County Wastewater District Code” or the “code”) as compiled and published by Code Publishing Company, Seattle, Washington, together with those secondary codes adopted by reference as authorized by California law, save and except those portions of the secondary codes as are deleted or modified by the provisions of the West County Wastewater District Code, is hereby adopted by reference as the official code of the West County Wastewater District in accordance with the provisions of California Health and Safety Code Section 6491.2 and California Government Code Sections 50022.1 to 50022.8, inclusive. 1.01.020 Title – Citation – Reference.

The code shall be known and may be cited as the “West County Wastewater District Code.” It shall be sufficient to refer to said code as the “West County Wastewater District Code” in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. It shall be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part or portion of the code as an addition to, amendment to, correction or repeal of the “West County Wastewater District Code.” Further reference may be had to the titles, chapters, sections and subsections of the West County Wastewater District Code and such references shall apply to that numbered title, chapter, section or subsection as it appears in the code. 1.01.030 Codification authority.

Thc code consists of all of the regulatory and penal ordinances and certain of the administrative ordinances of the district adopted pursuant to the provisions of California Health and Safety Code Sections 6490 through 6491.3, inclusive, California Government Code Sections 50022.1 through 50022.8, inclusive, and other applicable provisions of California law. Each provision of the code insofar as it is substantially the same as an existing provision relating to the same subject matter shall be construed as a restatement and continuation of such provision and not as a new enactment. 1.01.040 Ordinances passed prior to adoption of code.

All district ordinances adopted prior to adoption of the ordinance codified in this chapter, and the code are adopted and made a part of the code. [Ord. 5-15-07 § 4]

1.01.050 Reference applies to all amendments.

Whenever a reference is made to the code as the “West County Wastewater District Code,” the “code” or to any portion thereof, or to any ordinance of the district, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made. [Ord. 5-15-07 § 5]

1.01.060 Title, chapter and section headings.

Title, chapter, article and section headings in the code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the code. [Ord. 5-15-07 § 6]

1.01.070 Reference to specific ordinances.

The provisions of the code shall not in any manner affect matters of record which refer to, or are otherwise connected with, ordinances which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within the code. 1.01.080 Effect of code on past actions and obligations.

The adoption of the code or the repeal or amendment of any ordinance or part or portion of any ordinances of the district shall not in any manner:

A. Affect the prosecution for violations of ordinances, which violations were committed prior to the effective date thereof;

B. Be construed as a waiver of any license, fee, or penalty at said effective date due and unpaid under such ordinances;

C. Be construed as affecting any of the provisions of such ordinances relating to the collection of any such license, fee, or penalty, or the penal provisions applicable to any violation thereof; or

D. Affect the validity of any bond or cash deposit in lieu thereof required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. [Ord. 5-15-07 § 8]

1.01.090 Constitutionality.

If any section, subsection, sentence, clause or phrase of the code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of the code. The board of directors declares that it would have passed the code, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases had been declared invalid or unconstitutional, and if for any reason the code should be declared invalid or unconstitutional, then the original ordinance or ordinances shall be in full force and effect.
