RECORDS RETENTION AND DESTRUCTION POLICY

1.20.010 Records retention and destruction policy.

The board hereby adopts the records retention and destruction policy attached to the resolution codified in this chapter as Exhibit “A”1 and incorporated herein by reference. (Res. 2940 § 2, 2016)

1.20.020 Electronic mail (email) records retention policy.

The board hereby adopts the electronic mail (email) records retention policy attached to the resolution codified in this chapter as Exhibit “B”2 and incorporated herein by reference. The email policy is unchanged from previous versions. (Res. 2940 § 3, 2016)

1.20.030 Implementation of records retention and destruction policy and electronic mail (email) records retention policy.

The board hereby authorizes the general manager, or his/her designee, to interpret and implement the records retention and destruction policy and electronic mail (email) records retention policy (collectively referred to as the “policies”). In addition, the board authorizes the general manager, or his/her designee, to update or amend the policies as needed, without further approval from the board. The records identified within the policies, which include records retention schedules, are hereby authorized to be retained, transferred, duplicated and disposed of as provided within said policies, upon request of the applicable personnel and approval of the applicable personnel, without further action by the board. 1.20.040 Legal compliance.

The board hereby affirms that pursuant to Government Code Section 60201(b)(2), the policies and applicable schedules incorporated in this chapter comply with the Local Government Records Management Guidelines adopted by the California Secretary of State, classifies the district’s records by category, and establishes a standard procedure for destruction of district records. (Res. 2940 § 5, 2016)

1.20.050 Destruction of duplicate records.

Pursuant to Government Code Sections 53161 and 60200, the board hereby authorizes the general manager or his/her designee to destroy at any time any duplicate record, paper, or document of the district, while the original, whether in paper or electronic format, is retained for the legally required time period by the district.
