7.40.010 Rates and charges.
A. Effective April 1, 2009, the rate for the purchase of water stored in the SBBA shall be calculated taking into account the MWD Tier 1 rates, MWD Tier 2 rates and MWD Delta surcharges then in effect and shall be calculated as follows:
(70 percent of the MWD Tier 1 full service untreated volumetric rate per acre-foot as said rate may be changed from time to time) plus (30 percent of the MWD Tier 2 full service untreated volumetric rate per acre-foot as said rate may be changed from time to time) plus (the MWD Delta surcharge per acre-foot as said surcharge may be changed from time to time) = the rate per acre-foot for the purchase of stored water in the SBBA.
B. Western may establish terms and conditions for the sale of stored water in the SBBA as Western may determine, from time to time, in its discretion. (Res. 2604 §§ 1, 2, 2009)
