12-1.01 Short title.

The provisions of this title shall be cited and referred to as the “Watsonville Improvement Procedure Code”.

12-1.02 Assessment proceedings.

Proceedings for the acquisition or construction, or both, of any public improvements or property of a local nature, or the acquisition of lands or easements or buildings or improvements or property, or any or more than one thereof, therefor, may be held pursuant to the provisions of this Code, whether or not provided in any general law.

12-1.03 Pending proceedings.

This Code shall not apply to any proceedings in which the resolution of intention was adopted prior to November 7, 1974, except proceedings for a supplemental assessment, a reassessment, a refunding, and the curative provisions of this Code.

12-1.04 Alternative procedures.

The procedures provided in the several divisions or bond plans of this Code shall be alternative.

12-1.05 Code not exclusive.

The provisions of this Code shall not be exclusive. The resolution of intention in any proceeding under an act or general law may provide that such act or general law is supplemented by any part or parts of this Code.

12-1.06 Code superior.

The provisions of this Code shall be controlling over the provisions of any general law or act in conflict with the provisions of this Code in any proceeding taken pursuant to the provisions of this Code.

12-1.07 Municipal affairs.

This Code is adopted pursuant to the municipal affairs provision of the Charter of the City. In proceedings held pursuant to the provisions of this Code, which proceedings are a municipal affair, the general laws referred to in this Code are deemed a part of this Code.

12-1.08 State affairs.

In the event any proceedings held pursuant to the provisions of this Code shall be adjudged a State affair, it is hereby declared to be the intention that such proceedings were held pursuant to the general laws cited in this Code specified in the resolution of intention therein.

12-1.09 Single proceedings.

One or more acquisitions and improvements or acquisitions or improvements may be had in a single proceeding.
