13-11.01 Requirements.

(a)    After a final or parcel map is filed in the office of the County Recorder, it may be amended by a certificate of correction or an amending map for any of the purposes listed in Section 66469 of the Subdivision Map Act.

(b)    A recorded final or parcel map may also be modified by a certificate of correction or an amending map if: (1) there are changes in circumstances which make any or all of the conditions of the map no longer applicable or necessary; (2) the modifications do not impose any additional burden on the present fee owner of the property; (3) the modifications do not alter any right, title, or interest in the real property reflected on the recorded map; and (4) the City makes all the required findings as set forth in Section 13-4.09, Council action.

13-11.02 Form and contents.

The amending map or certificate of correction shall be prepared and signed by a registered civil engineer or licensed land surveyor. The form and contents of the amending map shall conform to the requirements of Section 13-4.13 for a final map amendment or Section 13-5.11 for a parcel map. The amending map or certificate of correction shall set forth in detail the corrections made and show the names of the present fee owners of the property affected by the correction.

13-11.03 Submittal to and approval by the City Engineer.

The amending map or certificate of correction shall be submitted to the City Engineer for review and approval.

The City Engineer shall examine the amending map or certificate of correction and if the only changes made are for the purposes listed in Section 66469 of the Subdivision Map Act, this fact shall be certified on the amending map or certificate of correction.

If the amending map or certificate of correction is for the purposes listed in Section 13-11.01(b), then, following review by the City Engineer, the amending map or certificate of correction shall be submitted to the City Council for review at a public hearing. The City Council shall find that the amending map or certificate of correction is consistent with the provisions of Section 13-11.01(b),

13-11.04 Filing with the County Recorder.

Following approval by the City Engineer or City Council, as appropriate, the amending map or certificate of correction certified by the City Engineer shall be filed in the office of the County Recorder. The original map shall be deemed to have been conclusively so corrected, and the amending map or certificate of correction shall provide constructive notice of all corrections in the same manner as though upon the original map.

13-11.05 Fees.

The fee for checking, processing, and recording the amended map or certificate of correction shall be in accordance with City Council resolution establishing fees and charges. A deposit to be applied toward this fee may be required by the City Engineer upon submittal of the amended map or certificate of correction for review.
