14-26.010 Restrictions.

Unless otherwise permitted by this chapter, it shall be unlawful not to have all merchandise, storage, display, or sales areas wholly within a completely enclosed building or structure or screened so as not to be visible from an adjacent public street or publicly operated parking lot, except that the area within a completely roofed street alcove or entryway may be utilized for merchandise display provided such merchandise is displayed inside the line of the building face and does not present a hazard to pedestrians or encroach on a required building exit.

14-26.020 Exceptions.

The following outdoor sales and commercial activities shall not be subject to the provisions of Section 14-26.010 of this chapter:

(a)    Automobiles, boat, trailer, camper, motor-cycle, and motorcycle sales and rentals;

(b)    Building material and supplies areas in the I-Districts;

(c)    Fruit and vegetable stands in the A-Districts;

(d)    Horticultural nurseries;

(e)    Vending machines, when located in service stations, motels, and other “drive-in” businesses;

(f)    Gasoline pumps, oil racks, and accessory items when located on pump islands;

(g)    Activities similar to those set forth in subsections (a) through (f) of this section as determined by the Zoning Administrator;

(h)    Parking lot sales not to exceed three (3) days during any three (3) month period; and

(i)    Sidewalk sales authorized by permit pursuant to Section 5-20.04 of this Code.

14-26.030 Special and Administrative Use Permits.

The following outdoor sales and commercial activities may be permitted upon review and approval of a Conditional Use Permit:

(a)    The following outdoor sales and commercial activities may be permitted upon the review and approval of an Administrative Use Permit by the Zoning Administrator:

(1)    Christmas tree sales (thirty (30) days maximum);

(2)    Firework sales;

(3)    Rummage sales (three (3) days maximum);

(4)    Sidewalk cafes (ninety (90) days maximum); and

(5)    Temporary circus and carnival activities (four (4) days maximum).

(b)    Permanent or temporary outdoor sales of merchandise not already specifically provided for in subsection (a) of this section may be permitted upon the review and approval of a Special Use Permit by the Commission.

14-26.040 Districts permitted.

Notwithstanding the provisions of Parts 11, 12, 13, and 14 of Chapter 14-16 of this title, the activities listed in Section 14-26.030 of this chapter shall be permitted only in the following districts:

(a)    CC—Central Commercial;

(b)    CT—Thoroughfare Commercial;

(c)    CN—Neighborhood Commercial; and

(d)    CNS—Neighborhood Shopping Center.
