7.40.010 Diverting water flow.

A. No person shall place or construct any dam, weir, bulkhead or other construction, or place any material in such a way, or utilize any trap or gate, for the purpose of diverting water from any main or branch ditch of the storm drain system of the city, except as provided in this chapter.

B. Any person desiring to divert waters at any point along the storm drain system of the city shall submit an application in writing to the city engineer for permission to do so, and the application shall be accompanied with a detailed description of the manner in which the applicant desires to make such diversion of water. The city engineer may issue a permit provided the applicant first signs an agreement with the city which shall provide in substance that such applicant claims no rights in the storm drains or the waters flowing therein except under the license of the city; that the city disclaims all responsibility for the maintenance of any flow of water at the point of diversion; that the license to divert water is nontransferable; and that the license to divert waters is revocable at any time.

C. After the granting of any license for the diversion of water, the means of diversion shall be constructed at the point and in the manner specified by the application and under the supervision of the city engineer; provided, that all costs of such construction, including any necessary repairs to the storm drain system, shall be borne by the applicant. 7.40.020 Ditches.

No person shall deposit in any ditch, drain or waterway within the city any brush, rubbish, weeds or other material that may hinder, stop or divert water flowing in the ditch, drain or waterway, or place on or near the top of the ditch, drain or waterway any brush, rubbish, weeds or other matter. 7.40.030 Waste – Irrigation water.

No person owning, occupying or having control of lands adjoining any portion of the storm drain system of the city shall cause or permit waste or irrigation water to flow into such storm drains or upon the right-of-way of the same. [Ord. 2018-203 § 2; Ord. 2010-126 § 1 (Exh. A)].

7.40.040 Wastewater on streets.

No person using water for commercial, domestic or irrigation purposes shall run any wastewater into or upon any public street, alley or other public place within the city. [Ord. 2010-126 § 1 (Exh. A)].
