10.34.010 Installation of parking signs.

The chief of police is authorized to install, maintain and remove signs in parking zones established or created by the city council by resolution for the purpose of, and in such numbers, and at such places as may be necessary, the safe and efficient regulation, control and inspection of parked vehicles in accordance with the provisions of this chapter. 10.34.020 Determination of maximum parking time limits.

The city chief of police is authorized to and shall cause appropriate signs to be installed and spaced at reasonable distances along the street curb, advising the public of the parking limitations, in accordance with this chapter. (Ord. 95-10 § 1 (part); Ord. 90-22 § 1 (part))

10.34.030 Parking zones--Permit required.

Parking zones shall be established by the city council by resolution. Thereafter, all vehicles parking in such parking zones must display a valid parking permit, in accordance with the resolution. Such zones may apply to public streets and/or to city-owned property. (Ord. 95-10 § 1 (part); Ord. 94-01 § 2: Ord. 91-14 § 1: Ord. 90-22 § 1 (part))

10.34.040 Issuance of parking permits.

A.    Parking permits shall be issued by the chief of police. Each permit shall state the parking zone it applies to and its expiration date. No more than one permit per vehicle shall be issued.

B.    Parking permits shall be issued to each person who maintains a residence or place of business in a particular parking zone. Parking permits may also be issued to any person or persons who have a need to be in a particular parking zone during particular hours as so designated by the city council.

C.    Parking permits shall be issued to qualifying individuals upon submission of a parking permit application to the chief of police along with all necessary fees, if any, as set by the city council by resolution. (Ord. 95-10 § 1 (part): Ord. 94-01 § 3: Ord. 90-22 § 1 (part))

10.34.050 Parking permit restrictions.

A parking permit shall not guarantee or reserve to the holder thereof a parking space in the designated parking zone to which the parking permit applies. (Ord. 94-01 § 4)

10.34.060 Substitution of vehicles.

Where the vehicle for which a parking permit has been issued has been sold, traded, or otherwise disposed of by the owner, and a substitute vehicle acquired by the parking permit holder, the parking permit may be used in the substitute vehicle provided the police department is informed in writing of the change and given the necessary information regarding the substitute vehicle. 10.34.070 Limited parking zones--Overtime parking separate offense.

Where a maximum parking time is indicated by sign, the leaving of a vehicle in a parking space so restricted for a period in excess of such maximum time shall be a separate and punishable offense for each and every maximum time period or portion of the maximum time period, during which the vehicle is left in the parking space in excess of the initial period. 10.34.080 Marking on vehicle tires--Unlawful to remove.

In the event that a police officer places on or under the tire of a vehicle a chalk mark or other identifying mark or object for the purpose of identifying the vehicle and its time of parking, it shall be unlawful for any person to erase or remove said chalk mark or identifying mark or object except by moving the vehicle to an entirely different parking stall. 10.34.090 Removal of vehicles.

The city police department is empowered to remove, or cause to have removed to the nearest garage or other place of safety, or to a garage designated or maintained by the city, any vehicle that is parked in any no parking zone in violation of this chapter. 10.34.100 Definitions.

For the purpose of this chapter, the following words and phrases are defined and shall be construed accordingly, unless it shall be apparent from the content that they have a different meaning:

A.    Parking Permit. Each person who maintains a residence or place of business in a parking zone, may upon presentation of proof of such residence or business to the city, receive a “parking permit” valid for no more than two years.

B.    “Parking zone” means a designated area wherein vehicles displaying a valid parking permit as described in this section shall be exempt from the time limit parking regulations or parking provisions which are established pursuant to this chapter. The parking permit shall not exempt any person from any other parking provisions of state law or city ordinance or resolution.

C.    “Vehicle” means an automobile, truck, motorcycle, or other motor-driven form of transportation. (Ord. 94-01 § 7)

10.34.110 Violation.

Notwithstanding section 10.08.040, violation of any of the provisions of this Chapter is unlawful and an offense. Such violations shall be punished as provided by Chapter 21.01 of Title 21.
