ALCOHOLIC BEVERAGES

16.20.010    Alcoholic beverages prohibited.

16.20.010 Alcoholic beverages prohibited.

No person shall use, possess or consume any alcoholic beverage, as defined in Section 23004 of the Business and Professions Code of the state, in the following city parks:

(1)    Napoleon Square which lies generally between Fifth and Sixth Streets and G and H Streets in the city;

(2)    Washington Square which lies generally at the northeast, northwest, southeast and southwest corners of 10th Street and E Street in the city;

(3)    Plaza Park which lies generally between First Street and the Marysville Levee, and between D Street and E Street in the city;

(4)    East Lake Park which lies generally on the westside of Yuba Street between Thirteenth and Seventeenth Streets in the city;

(5)    Stephen J. Field Park which lies between Greeley Drive and Boulton Way at their intersection with Rideout Way in the city;

(6)    Gavin Park which lies generally between Val Drive and Chele Avenue on the southside of Johnson Avenue in the city;

(7)    Miner Park which lies generally between Fourteenth and Fifteenth Streets and between Swezy Street and Sampson Street in the city;

(8)    Triplett Park which lies generally on the northside of Rideout Way between Covillaud Street and Ahern Street in the city;

(9)    Ellis Lake which lies generally between Ninth and Sixteenth Streets and between B Street and D Street in the city;

(10)    Yuba Park which lies generally between Yuba Street and Ramirez Street, and between the Marysville levee and East Tenth Street in the City. (Ord. 1235, 1998; Ord. 1193, 1994; Ord. 971 § 1, 1982: Ord. 906 § 1, 1979; Ord. 903 § 1 (part), 1979).

16.20.015 Use by permit.

Notwithstanding the provisions of Section 16.20.010, alcoholic beverages may be used, possessed and consumed in any of the parks described in said section if, prior to such use, possession or consumption, a permit is obtained from the city. The fee for such permit and the manner in which it is issued shall be set forth in a resolution adopted by the council. (Ord. 1017 § 22, 1984: Ord. 971 § 2, 1982).

16.20.020 Penalty for violations.

Any person violating any provision of this chapter is guilty of an infraction and shall be punished by a fine of up to two hundred fifty dollars. (Ord. 903 § 1 (part), 1979).

16.20.030 Signs.

The director of public works is authorized and directed to place and maintain appropriate signs in the parks described in Section 16.20.010 giving notice of the prohibition against the sale, possession or consumption of alcoholic beverages in said parks. (Ord. 903 § 1 (part), 1979).
