18.82.010 Purpose.

The city council or the planning commission, with the assistance of the city planner, shall prepare for adoption by the city council a comprehensive, long-term general plan, and any amendment thereto, for the physical development of the city and of any land outside the city’s boundaries which in the council’s or commission’s judgment bears relation to the physical development of the city. The general plan shall include the mandatory elements specified in the California Government Code and may include such other elements as the commission or council deems necessary or convenient to further the interest of the city. 18.82.020 When allowed.

Whenever the public necessity, convenience, general welfare, or good land use planning practice may require, the city council may by resolution, subject to the procedure provided in this chapter, adopt, amend or change the general plan. (Ord. 1141 § 2 (part), 1992).

18.82.030 Initiation.

Adoption, amendment or change to the general plan may be initiated by the city council or planning commission or by petition of one or more property owners within the area directly affected by the proposed adoption, amendment or change. Petitions shall be filed with the city planner on prescribed forms and accompanied by such data and information as may be required for that purpose by the city council. The petitioner shall also deposit a fee in an amount established by resolution, no part of which is refundable. All petitions or city council resolutions regarding such changes shall be referred to the planning commission. (Ord. 1149 § 98, 1992: Ord. 1141 § 2 (part), 1992).

18.82.035 Planning commission action.

The planning commission shall hold at least one public hearing on the adoption of the general plan or any amendment thereto and make a recommendation to the city council. (Ord. 1149 § 99, 1992).

18.82.040 City council action.

Upon receipt of a recommendation on the adoption of a general plan or amendments thereto from the planning commission, the city council shall hold at least one public hearing on the proposal and approve, modify and approve, or disapprove the proposal. However, any substantial modification proposed by the city council not previously considered by the planning commission during its hearings shall first be referred to the planning commission for its recommendation. Failure of the planning commission to report within forty-five days after the referral, or within a time specified by the city council, shall be deemed a recommendation for approval.
