M-1 LIGHT INDUSTRIAL DISTRICT

16.44.010 Purpose.
The purpose and intent of the M-1 district is to:
(1) Improve the exterior appearance of buildings and uses allowed in the district through implementation of design guidelines;
(2) Protect nearby residents from detrimental effects of non-residential uses through the use permit review process;
(3) Provide opportunities for some existing light industrial land uses, which have minimal impact on the environment and which are compatible with adjacent residential uses, to remain on Hamilton Avenue. (Ord. 903 § 3 (part), 2001).
16.44.020 Permitted uses.
There are no permitted uses in the M-1 district. (Ord. 903 § 3 (part), 2001).
16.44.030 Conditional uses.
Conditional uses allowed in the M-1 district, subject to obtaining a use permit, are as follows:
(1) Offices, excluding medical and dental offices;
(2) Light industrial uses;
(3) Outside storage of material or equipment, incidental to the main use and screened;
(4) Activities involving the use of hazardous material, incidental to the main use and not requiring an H occupancy as determined by the Menlo Park Fire Protection District;
(5) Public utilities and facilities in accordance with Chapter 16.76 of this title;
(6) Private schools and churches in accordance with Chapter 16.78 of this title. (Ord. 903 § 3 (part), 2001).
16.44.040 Pre-existing and relocated uses.
Legally established pre-existing and relocated uses from land formerly zoned M-2 along Hamilton Avenue are allowed in the M-1 district, subject to applying for a use permit within one (1) year of the effective date of the ordinance codified in this chapter and subject to receiving approval of said use permit within two (2) years of the effective date of the ordinance codified in this chapter. The review of the use permit request shall be limited to operational and appearance issues that would not affect the ongoing viability of the use. Pre-existing and relocated uses are as follows:
(1) Construction materials storage and distribution;
(2) Construction services, general contractor;
(3) Construction services, heating, ventilation and air conditioning;
(4) Construction services, painting;
(5) Construction services, plumbing;
(6) Equipment sales and rentals;
(7) Manufacturing, cabinets;
(8) Manufacturing, custom woodworking;
(9) Manufacturing, rope;
(10) Manufacturing, screens;
(11) Outside storage of material, equipment or vehicles, incidental to the main use and screened;
(12) Activities involving the use of hazardous material, incidental to the main use and not requiring an H occupancy as determined by the Menlo Park Fire Protection District. (Ord. 903 § 3 (part), 2001).
16.44.050 Development regulations.
Development regulations in the M-1 district are as follows:
(1) Minimum lot area: twenty-five thousand (25,000) square feet;
(2) Minimum lot dimensions:
(A) One hundred (100) feet width,
(B) One hundred (100) feet depth,
(3) Minimum yards:
(A) Twenty (20) feet front,
(B) Zero (0) feet rear,
(C) Ten (10) feet sides, except that a side yard may be reduced to zero feet provided that the other side yard is correspondingly increased to twenty (20) feet;
(4) Maximum building coverage: fifty percent (50%) of the lot area;
(5) Minimum on-site landscaping:
(A) Office uses: thirty percent (30%) of the lot area,
(B) All other uses: fifteen percent (15%) of the lot area;
(6) Maximum floor area ratio (FAR):
(A) Office: twenty percent (20%) of the lot area,
(B) Light industrial uses and pre-existing and relocated uses: fifty-five percent (55%) of the lot area,
(C) Combined office and light industrial uses: forty-five percent (45%) of the lot area, provided the maximum FAR of the office use shall not exceed twenty percent (20%) of the lot area;
(7) Maximum height of structures: thirty-two (32) feet from finished grade;
(8) In the case of conditional uses, the planning commission may require additional regulations. (Ord. 903 § 3 (part), 2001).
16.44.060 Design guidelines.
Construction of a new building, additions to an existing building, and exterior alterations of an existing building occurring within the M- 1 district shall adhere to applicable design guidelines adopted by the City Council. Design guidelines shall be enforced through architectural control as set forth in Section 16.68.020 of this title. (Ord. 903 § 3 (part), 2001).
