There is created the office of chief of police. The chief shall be chosen solely on the basis of his or her law enforcement, executive and administrative qualifications, and shall be appointed and supervised by the city manager as set forth in Section 2.12.060(B)(2). 2.40.020 Police department.
There is created a police department for the city which shall consist of a chief of police and as many employees as the city manager may designate, as set forth in Section 2.12.060(B)(2). (Ord. 01-10 § 4 (part): prior code § 2.101)
2.40.030 Powers and duties.
The chief of police shall:
A. Exercise the powers of control over the police department including but not limited to control and custody of police facilities and their equipment, books, records and all other property authorized for use of the police department;
B. Appoint one or more police officers subject to the approval of the city manager as set forth in Section 2.12.060(B)(2);
C. Make, prescribe, review and evaluate such department rules and regulations as he or she deems advisable not in conflict with any applicable federal or state statute or city ordinance. Such rules and regulations shall be binding, on all members of the department and shall provide for, but not be limited to, the conduct of members, uniforms and equipment to be worn or used, hours of service, manpower deployment schedules, vacation schedules, leaves of absence, training, suspension and discipline and other matters necessary or desirable for efficiency of the department;
D. Appoint special, temporary or reserve police officers to preserve public order, who may be entitled to compensation from the city, upon authorization of the city manager. Special or temporary police officers shall obey all rules, regulations and orders of the police department;
E. Keep the city jail and maintain custody of all persons incarcerated therein, and maintain an accounting of, and method of safekeeping of, any money and property removed from each person incarcerated therein;
F. Assure that all members of the police department enforce all ordinances of the city, and all federal and state statutes applicable to, or delegating the power of enforcement thereof to, the police department of the city;
G. Preserve order and prevent infractions of the law, and arrest violators thereof, and be responsible for the suppression of riot, public tumult, disturbance of the peace, or resistance against laws or public authorities to the lawful exercise of their functions. The chief of police shall also be entitled to the powers conferred upon sheriffs by general law and in all respects is entitled to the same protection;
H. Direct a sufficient number of police officers to attend and keep order at any public meeting in the city at which, in his or her opinion, a breach of the peace may occur;
I. Perform any license fee or tax collection services prescribed by law;
J. Take custody of all lost, abandoned or stolen property recovered in the city, and maintain an accurate accounting thereof. He or she shall also assure the safety and protection of the property, and if the rightful owner is not found, he or she shall turn the property or proceeds thereof over to an appropriate city officer, or otherwise dispose of such unclaimed property in the manner as may be prescribed by law;
K. Keep a detailed and current record of all fees received for service of process or other money collected by his or her department or paid to him or her in his or her official capacity. Such record shall be open for public inspection during office hours;
L. Deposit with the city finance director/treasurer or other designated authority all money collected by his or her department as required by law;
M. Establish and maintain such other records pertaining to the conduct of police business as required by law, ordinance, resolution, competent authority, or efficient operation of the police department;
N. Require that all officers receive at least as much recruit and in-service training as the minimum prescribed by the California Peace Officer Standards and Training Commission;
O. Appoint and designate a commanding officer to act in his or her place whenever he or she is absent from the city on authorized leave of absence or vacation, or otherwise so incapacitated or disabled from illness or injury as to preclude effective performance of his or her duties. Such commanding officer shall possess all of the authority and be responsible for the performance of all of the duties of the chief of police, and shall be subject to approval of the city manager;
P. Perform such other services as city regulations require;
Q. Make and maintain crime reports and other reports he or she deems advisable, and file copies of such reports, where required, with other public agencies as may be prescribed by law;
R. Investigate all charges made against officers and civilian employees by his or her subordinate officers, by citizens, or by higher authority. He or she shall assure that all evidence relating to alleged offenses is discovered and properly documented;
S. Conduct staff meetings and inspections to evaluate and improve police department performance and efficiency;
T. Provide information to and maintain external relations with the public;
U. Provide advice to the city manager and city council on matters relating to law enforcement. (Ord. 01-10 § 4 (part): prior code § 2.102)
2.40.040 Discretionary powers.
The chief of police may, in his or her discretion:
A. Establish such divisions as provided by ordinance or as may be necessary to discharge the duties of his or her office;
B. With approval of the city manager, designate personnel as necessary to assist him or her in the administration and supervisory discharge of his or her duties. (Ord. 01-10 § 4 (part): prior code § 2.103)
