10.04.010 Definitions.
Whenever in this title or any resolution of the city council adopted pursuant hereto, any words or phrases are used which are not defined herein or in such resolutions, but which are defined in the Vehicle Code of the state, the definition and meaning shall be applied as set forth and contained in the provisions of the Vehicle Code and amendments thereto. 10.04.020 Rules and regulations regulating operation of vehicles adopted by resolution.
A. The city council, within the reasonable exercise of the police power, may by resolution adopt rules and regulations relating to the operation of vehicles upon the streets and highways of the city as authorized by Division 11 of the Vehicle Code of the state upon the following matters:
1. Regulating or prohibiting processions or assemblages on the streets and highways of the city;
2. Regulating traffic by means of traffic officers;
3. Regulating traffic by means of semaphores or other traffic-control signaling devices;
4. Designating particular streets or highways as one-way streets or highways and requiring that all vehicles thereon be moved in one specified direction;
5. Designating any street or highway as a through street or highway requiring that all vehicles stop before entering or crossing the same or designating any intersection as a stop intersection and requiring all vehicles to stop at one or more entrances to such intersection;
6. Closing any street or highway or portion thereof to vehicular traffic when in the opinion of the city council such street or highway or any portion thereof is no longer needed for vehicular traffic;
7. Prohibiting the use of particular streets or highways by certain vehicles except as otherwise provided by the Public Utilities Commission pursuant to Article 2 (commencing with Section 1031) of Chapter 5 of Part 1 of Division 1 of the Public Utilities Code.
B. No resolution adopted under subsection (A)(4), (5), (6) and (7) of this section shall be effective until signs giving notice of such traffic laws are posted at all entrances to streets or highways or parts thereof affected. All signs giving notices of any such traffic laws and regulations shall conform to the specifications applicable thereto as set forth in the Vehicle Code. (Ord. 02-5 § 12 (part): prior code § 10.2)
10.04.030 Regulations applying to state highways.
Any provision of this title which regulates traffic or delegates the regulation of traffic upon state highways in any way for which the approval of the Department of Transportation is required by law, shall cease to be operative six months after receipt by the city council of written notice of withdrawal of approval of the Department of Transportation. Immediately upon the effective date of such revocation, the city clerk shall enter upon the original copy of the ordinance from which this section was derived a notification of such withdrawal.
Whenever this chapter delegates authority to a city officer, or authorizes action by the city council to regulate traffic upon a state highway in any way which by law requires the prior approval of the Department of Transportation, no such officer shall exercise such authority nor shall such action by the city council be effective with respect to any state highway, without the prior approval in writing of the Department of Transportation when and to the extent required by Division 9 and Division 11 of the State Vehicle Code.
