10.16.010 Regulation of parking by resolution.

The city council may, by resolution, regulate parking upon any street or highway of the city, including the determination and designation of parking time limit within any designated area within the city, and prohibiting parking upon any street or highway or portion thereof, and it is authorized and directed, in the event of the adoption of any such resolution pursuant hereto, to place, paint and maintain or cause to be placed, painted or maintained the necessary signs, markers or painted curbs that may be required by the provisions of the Vehicle Code of the state and any amendments thereto. 10.16.020 Removal of tire marking prohibited.

No person shall remove or cause to be removed, altered, covered or distorted, in any manner, marks placed on a vehicle tire by a parking enforcement officer of the city while the vehicle is parked in a time limit zone. (Ord. 02-5 § 12 (part): prior code § 10.10.010)

10.16.030 Regulation of parking in certain emergencies.

Wherever the police chief determines that an emergency traffic congestion likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons, he or she shall have authority to place or have placed temporary signs indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys or sides thereof as the police chief may designate during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the police chief shall cause such signs to be removed promptly thereafter.

When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the direction and provisions of such signs. (Prior code § 10.11)

10.16.040 Painting of curbs to indicate parking—Meaning of different colors.

Whenever the city council enacts parking regulations by ordinance or resolution and indicates them by the use of paint upon curbs pursuant to Section 21458 of the Vehicle Code of the state the regulations shall be effective on the days and at the times prescribed as follows:

A.    Red indicates no stopping, standing or parking, whether the vehicle is attended or unattended, except that a bus may stop in a red zone marked or signposted as a bus loading zone.

B.    Yellow indicates no stopping, standing or parking between the hours of eight a.m. and six p.m. of any day, except Sundays and holidays, for any purpose other than the loading or unloading of passengers or freight. When a yellow zone is adjacent to school premises, the prohibition shall apply only on school days between the hours of seven-thirty a.m. and nine a.m. and two p.m. to four p.m.

When designating yellow zones the city council shall designate one of two types of yellow zones as follows:

1.    Twenty (20) minute zone in which loading or unloading of passengers or freight shall not consume more than twenty (20) minutes;

2.    Sixty (60) minute zone in which loading or unloading of passengers or freight shall not consume more than sixty (60) minutes.

C.    White indicates no stopping, standing or parking for any purpose other than loading or unloading passengers or depositing of mail in an adjacent mailbox between the hours of eight a.m. and six p.m. of any day, except Sundays and holidays. Such permitted stopping, standing or parking during restricted hours shall not consume more than five minutes; provided, however, that when a white zone is adjacent to school premises the restriction shall apply on school days between eight-thirty a.m. and three-thirty p.m., and that when a white zone is in front of a mail box the restriction shall apply at all times.

D.    Green indicates no standing, stopping or parking for longer than twenty (20) minutes at any time between eight a.m. and six p.m. of any day, except Sundays and holidays.

E.    Blue indicates no stopping, standing, parking or use for any purpose whatsoever, at any time, except by vehicles which display a distinguishing license plate or a placard issued pursuant to California Vehicle Code Sections 22511.5 or 9105. (Prior code § 10.11.1)

10.16.050 Parking on Money Way.

No person shall stop, park or leave standing any vehicle, whether attended or unattended, upon Money Way in the city, except within a yellow zone approved by resolution of the city council and in conformance with regulations established for parking in a yellow zone in which loading or unloading of passengers or freight shall not consume more than twenty (20) minutes. For any yellow zone approved on Money Way, restrictions and regulations relating to yellow zones shall apply at all times, without limitation with regard to time of day, day of week or holidays. 10.16.060 Parking more than seventy-two consecutive hours.

A.    No person shall park or leave standing a vehicle upon any public street for seventy-two (72) or more consecutive hours.

B.    Any vehicle parked or left standing in violation of subsection A of this section may be removed by any regularly employed and salaried officer of the police department. Such removal shall be done in accordance with the applicable provision of the Vehicle Code of the state. Prior to such removal and if the officer knows or is able to ascertain from the registration records of the Department of Motor Vehicles the name and address of registered and legal owner thereof, the officer shall give or cause to be given twenty-four (24) hours’ notice in writing to such registered and legal owner of the intent to remove such vehicle and the grounds therefore. 10.16.070 Parking for sale or repair.

No person shall park a vehicle upon any roadway for the principal purpose of:

A.    Displaying such vehicle for sale;

B.    Greasing, changing oil of or repairing such vehicle, except repairs necessitated by an emergency. (Ord. 02-5 § 12 (part): prior code § 10.13)

10.16.080 Parking of trailers, wide vehicles.

A.    Parking of Commercial Trailers. No person shall park, maintain stationary or leave unattended on any public street or right-of-way for road purposes within the city for a period of time longer than two hours any commercial trailer or semi-trailer, unless such vehicle is attached to a truck, tractor or other vehicle capable of moving the trailer or semi-trailer.

B.    Parking of Wide Vehicles. No person shall stop, maintain stationary, leave unattended or park any vehicle on any public street or right of way for road purposes within the city for a period of time longer than two hours under any one of the following circumstances:

1.    The vehicle has a width or load width in excess of eighty-four (84) inches.

2.    Any part of the vehicle or load is within ten (10) feet of the center of the street.

3.    Any part of the vehicle or load is located further than ninety-six inches (96) from the face of curb.

4.    The vehicle has a manufacturer’s gross vehicle weight rating of ten thousand (10,000) pounds or more.

C.    Exception. Subsection A of this section shall not apply to trailers or semi-trailers in the process of being loaded or unloaded, nor shall it apply to any trailer or semi-trailer which is disabled in such a manner and to such an extent that it is impossible to avoid stopping and temporarily leaving the disabled trailer or semi-trailer on the portion of the street or right of way ordinarily used for vehicular parking.

D.    Findings and Determination. The city council finds and determines that:

1.    A dangerous hazard exists within the city in connection with the on-street parking on public rights-of-way of large recreational vehicles and commercial trailers and semi-trailer rigs;

2.    There have been many instances where the owners or operators of commercial trailers, commercial semi-trailers and trailer rigs have detached the commercial trailers or semi-trailers from the truck tractor thereof, and have left the same stored upon public streets many times overnight, and sometimes for several days and nights;

3.    Storage of large recreational vehicles and attached and detached trailers and semitrailers on public streets is detrimental to the public health, safety and welfare inasmuch as the same are a hazard to traffic and other persons lawfully using the streets, and that such storage is not the parking or standing of a vehicle as contemplated by the Vehicle Code; and

4.    The storage of detached trailers or semi-trailers on public streets is not an authorized public use of the streets, and should be restricted. (Ord. 02-5 § 12 (part): prior code § 10.17)

10.16.090 Lines or markings indicating parking spaces—Parking within spaces.

The superintendent of streets shall have lines or markings painted upon the curb or street designating each public parking space. No person shall park any vehicle across any such line or marking, or park a vehicle in such a position that it shall not be entirely within the space designated by such lines or markings. 10.16.100 Privately owned off-street parking facilities designated.

The city council finds and declares that the following described privately owned and maintained off-street parking facilities within the city are generally held open for the use of the public or purposes of vehicular parking:

A.

10.16.110 Private parking lots.

A.    No person shall park, leave standing, or cause or permit to be left standing any vehicle upon any privately owned off-street parking facility or lot when the adjoining business commercial establishments are not open for business without the written consent of the owner of such privately owned parking facility or lot.

B.    No person shall enter and remain upon any privately owned off-street parking facility or lot when the adjoining business or commercial establishments are not open for business without the written consent of the owner of such privately owned parking facility or lot. 10.16.120 Statutory provisions applicable.

The provisions of California Vehicle Code Sections 22507.8, 22350, 23103, 23109 and of California Vehicle Code Division 16.5 (Sections 38000 et seq.) and of any other applicable California Vehicle Code sections now in effect or hereafter amended shall apply to all of the privately owned and maintained off-street parking facilities described in Section 10.16.100 of this chapter.
