10.32.010 Skateboards or similar devices defined.

“Skateboard or similar device” means any multiwheeled device which is utilized to transport one or more persons thereon and is propelled or pushed by the operator’s human power or by gravitational force or by ancillary motors or engine. Skateboard or similar device shall not include bicycles or wheeled devices required to be used by one who is disabled, but shall include, without limitation, rollerskates, coasters, scooters, and toy vehicles. 10.32.020 Prohibitions on operations.

No person shall operate or ride a skateboard or similar device upon:

A.    The sidewalks of Main Street, bounded on the south by Pope Street and north by Pine Street;

B.    Any public street or public sidewalk fronting a commercial establishment or located within a commercially zoned district as defined in Section 17.04.160.

C.    Any public street or public sidewalk adjacent to property on which a school is located, from one hour before through one hour after school is open for educational instruction;

D.    Any private sidewalk or private driving surface fronting or adjacent to a commercial establishment. (Ord. 02-5 § 12 (part): prior code § 10.20)

10.32.030 Restrictions on operation.

A.    No person shall operate or ride a skateboard or similar device upon any sidewalk, street, or parking area in a manner which endangers the safety of any other person or property or restricts the movements of pedestrians. Operating or riding a skateboard or similar device within five feet of a pedestrian shall constitute endangerment.

B.    Any person riding a skateboard or similar device at a recreational skateboard facility owned by the city shall wear a helmet, elbow pads, and kneepads while engaged in such activity. (Prior code § 10.21)

10.32.040 Violation—Penalty.

Any person failing to comply with provisions of this chapter shall be guilty of an infraction. Upon a first conviction, the violator shall be punished by a fine of not more than ten dollars ($10.00) and upon a second conviction by a fine of not less than twenty-five dollars ($25.00). Where this chapter has been violated by persons under the age of eighteen (18) years, in lieu of such fines as provided hereunder, the court may prohibit the operation of a skateboard or similar device by the person upon the streets, alleys and public places in the city for a period not to exceed thirty (30) days, and if the juvenile owns or controls a skateboard or similar device, may order such item to be impounded at the police department for the period so specified by the court. The court may order permanent confiscation of the skateboard or similar device. (Prior code § 10.22)
