12.04.010 Definitions.

As used in this title, unless the context otherwise clearly indicates, the following definitions apply:

“Parkway” means the area between the sidewalk and the curb of any street, and where there is not sidewalk that area between the edge of the roadway and the property line adjacent thereto. The parkway shall also include any area within a roadway which is not opened to vehicular travel.

“Roadway” means that portion of a street improved, designed, or ordinarily used for vehicular travel.

“Sidewalk” means any surface provided for the exclusive use of pedestrians.

“Street” means the entire area between fence or building lines of any street, way, alley, roadway or thoroughfare in the city opened to the use of public or dedicated to public use or used by the public or owned or maintained by the city or in which the city may have any right, title, interest, easement or claim, and shall embrace that portion of such street, way, alley, roadway or thoroughfare set apart for sidewalk, parkway or pedestrian travel and use. “Street” also includes curbs and gutters as well as the portion devoted to vehicular travel. 12.04.020 Duties of superintendent of streets.

It shall be the duty of the superintendent of streets to enforce all of the provisions of this title and to oversee and direct all work provided for herein, he or she shall direct the manner in which repairs shall be made, in accordance with the regulations herein provided or which may hereafter be adopted. It shall be the duty of the superintendent of streets to cause all surplus material from such work to be removed after the work is finished, or during its progress, by the party excavating and using the street, alley, sidewalk, public square or place, for the purposes contemplated and provided for herein.
