4-17-01 Definitions.

“Authorized uniform” shall mean any apparel, clothing, equipment, or gear worn by security professionals while on duty, or otherwise engaged in tasks or functions related to their profession and assigned by their employer.

“Badge or insignia” shall mean any symbol, item or accoutrement that represents, signifies, or identifies the wearer as a security professional. These include, but are not limited to: metal or cloth emblems, embroidered or printed patches worn on the shirt, items worn on a belt, neck chain or any other visible location that would reasonably resemble an official badge or emblem of authority.

“Identification card” shall mean a license or registration card issued pursuant to the Private Security Services Act, California Business and Professions Code Section 7580, et seq.

“Private patrol operator, security guard, security officer or street patrolperson” is defined by the Private Security Services Act, Section 7582.1, and shall have the same meaning for purposes of this chapter. The term “security professional” is synonymous with private patrol operator, security guard, security officer and street patrolperson.

“Vehicle” shall mean any mode of transportation used by security professionals in the official performance of their duties.

4-17-02 Business license.

Every private patrol operator or operator of a private patrol service located or operating within the City shall first procure a business license from the City to do so in accordance with Chapter 3-1 TMC. Prior to issuance of a business license, every private patrol operator or operator of a private patrol service intending to locate or operate within the City shall be required to provide proof of compliance with the requirements of this chapter inclusive to the Chief of Police or his/her designee.

4-17-03 Registration required.

(a) Every private patrol operator or operator of a private patrol service located or operating within the City shall register their name and file a copy of their State-issued PPO license with the Police Department.

(b) Every private patrol operator or operator of a private patrol service located or operating within the City shall register the name and State identification card number of every security guard, security officer and street patrolperson in their employ with the Police Department. The provisions of this section are intended to apply to those security guards, security officers, and street patrolpersons regularly located or operating within the City or who may be located or operate within the City.

(c) Registration shall occur once annually by the first semi-annual due date for payment of business license taxes no later than February 15th. No fees may be charged for registration as required by this chapter.

4-17-04 Uniforms.

(a) Uniforms worn by security professionals shall consist of a single color uniform or a uniform of contrasting garments (shirt and pants of differing colors) as described below:

(1) Single color: any color except dark blue, black or tan; or

(2) Contrasting colors: upper body apparel including shirt or vest, excluding jacket; any color except dark blue, black, or tan.

(b) Unless authorized by this section, security professionals shall only wear their authorized uniform while engaged in activities authorized by their employer or client.

(c) The Chief of Police or designee may authorize special uniform apparel for security professionals working at specific businesses, or at events where such specialized uniform would be of benefit to the event, the Police Department, and the public.

4-17-05 Badge/insignia.

The design of the badge, patch, or any insignia shall comply with the provisions of the Private Security Services Act, California Business and Professions Code Section 7580 et seq., including the requirement that a private patrol licensee or officer, director, partner, manager, or employee of a private patrol licensee wearing a distinctive uniform shall wear a patch on each shoulder of his or her uniform that reads “private security” and that includes the name of the private patrol company by which the person is employed or for which the person is a representative and a badge or cloth patch on the upper left breast of the uniform. The provisions of this section shall apply to the uniform and jacket worn as part of the authorized uniform.

4-17-06 Vehicles.

(a) Security professionals are prohibited from using any vehicle which is an imitation of, or resembles, or that could reasonably be mistaken for a marked law enforcement vehicle used by the City of Turlock, or any other law enforcement agency within Stanislaus County including, but not limited to, California Highway Patrol, Stanislaus County Sheriff’s Department and Stanislaus County Probation Department.

(b) Vehicles used by security professionals shall not be painted black and white, resembling a Turlock police vehicle, or have any significant amount of black and white contrasting color that would be reasonably mistaken for a marked law enforcement vehicle.

(c) Vehicles may not be all black or all white with no other colors visible.

(d) Vehicles used by security professionals shall have lettering visible from each side and the rear of the vehicle, no less than two and one-half (2.5") inches in height, which spells, at a minimum, S-E-C-U-R-I-T-Y in a color contrasting with the vehicle color. Such lettering may serve as the “other colors visible” as described in subsection (c) of this section.

(1) The terms “security patrol,” “private security,” “security guard” or similar identification will be permissible.

(2) The width of the letters will be consistent with the height, making the lettering reasonably visible.

(e) Overhead (light bars) or other mounted lights with amber or yellow coverings are permissible; provided, that they are in compliance with local, State, and Federal ordinances or laws and are not utilized in violation of any local, State, or Federal ordinance or law.

(f) Personally owned vehicles used by security professionals in the course of their employment are not exempt from this section.

(g) A private vehicle used solely to transport the security professional to a work station or location where the security professional does not use that vehicle in the performance of his/her duties is exempt from this section.

(h) Golf carts, all terrain vehicles, and similar modes of transportation used only on private property are exempt from this section.

(i) In the event a security professional opts to use a bicycle, motorcycle, or other similar vehicle in the course of his/her duties (except on private property), the Chief of Police or his or her designee will retain the discretion to require markings on that vehicle in accordance with this chapter and the Private Security Services Act, California Business and Professions Code Section 7580 et seq.

4-17-07 Existing licensees.

Each existing licensed patrol operator or operator of a private patrol service located or operating within the City shall comply with the requirements of this chapter within eighteen (18) months following the adoption of the ordinance codified in this chapter.
