2.04.010 Election of members.

All members of the City Council and the Mayor shall run at large for election within the city. (Prior code § 2-5)

2.04.020 Meetings—Time.

The regular meetings of the City Council shall be held at 7:00 p.m. on the first and third Tuesday of each month. The Council may schedule informal pre-meetings on regular Council meeting days for the purpose of receiving informational presentations from City staff or others. (Ord. 1996-4 § 1)

2.04.030 Electronic meetings.

During a declared emergency or disaster in the city relating to an epidemic or other incident where the nature of the physical environment presents a risk to public health, as a result of the emergency or disaster, the City Manager is authorized to schedule City Council meetings as electronic meetings if the capacity for such meetings is available, subject to the provisions of this section, including any meeting held at the City Council chambers or other location where any or all of the members of the City Council are present.

A.    All City Council members and the Mayor shall be allowed to attend and participate in City Council meetings by such telephonic, video conferencing, or other electronic means as are made available by the City Manager that allow for real-time participation and visibility (audio or video) by the public (“electronic means”), as provided herein. Mayor and Councilmembers may, if permitted by the City Manager, participate in such meetings from the regular meeting location.

B.    Electronic means, except where not consistent with the Colorado Open Meetings Law, shall include telephone, video, or web-based conferencing means made available by the City Manager that:

1.    Allows the Mayor and all Councilmembers and city staff to see (to the extent possible), hear and communicate with each other, the City Manager, the City Clerk, and the City Attorney;

2.    Allows the public to hear and view, provided the meeting is visible and the person has adequate technological connection, the following: the meeting; public statements by the Mayor, Councilmembers and staff; voting; and materials presented to the Mayor and Councilmembers; and

3.    Allows for oral public comment, to the extent possible, and written public comment (including before a meeting) that can be visible to the public and City Council as would be allowed by applicable council policies, subject to the limitations of this section and as determined by the mayor to preserve the orderly conduct of the meeting, provided written public comment shall be entered into the record but may be relied upon by any councilmember.

C.    If the Mayor and any councilmember’s ability to participate by electronic means is disconnected or delayed, the City Council may elect to proceed with the meeting provided a quorum remains present.

D.    No public hearings on quasi-judicial matters and no votes taking quasi-judicial actions shall be taken during an emergency meeting , as defined, or electronic meeting unless the City Council adopts a resolution establishing guidelines for such matters, consistent with this section and in conformance with the requirements of the Charter, Glendale Code of Ordinances, and the requirements of due process.

E.    During a meeting held pursuant to this section, members of the public shall not be entitled or permitted to be present in the physical location where the meeting occurs.

F.    During a meeting held pursuant to this section, Councilmembers shall not engage in any discussions of the business unless such discussions are audible or visible to the public through electronic means, except for executive sessions.

G.    All votes shall be conducted by a roll call vote that discloses the identity of the person voting and that person’s vote.

H.    All electronic meetings conducted pursuant to this section shall be recorded.

I.    Minutes of the meeting shall be taken and promptly prepared for review and approval by the City Council at the next regular or special meeting;

J.    A quorum may be established by the attendance of Councilmembers through electronic means.

K.    Executive sessions and study sessions may be conducted by electronic means if held in accordance with the Colorado Open Meetings Law and city policies applicable to such meetings. Public comment shall not be required during such meetings and confidentiality of executive sessions shall be maintained. (Ord. 2020-3 § 1)
