9.39.010 Registration required.

Any business that meets the definition of a “cigar-tobacco bar” under C.R.S. Section 25-14-203(4) shall not be exempt from the smoking restrictions under C.R.S. Section 25-14-205(1)(e) until such business has registered with the City Clerk. (Ord. 2006-6 § 1 (part))

9.39.020 Registration process.

The business shall complete the forms provided by the City Clerk, which shall include the following:

A. Name, address, telephone number, and Glendale business license number of the business; and

B. Name, address, telephone number, Colorado driver’s license number or Social Security number of the owner or officer of the business completing the form; and

C. Figures showing all individual components of one (1) of the following for the calendar year ending December 31, 2005, and every calendar year subsequent:

1. That the business generated at least five percent (5%) or more of its total annual gross income from the on-site sale of tobacco products and the rental of on-site humidors, not including any sales from vending machines; or

2. That the business generated at least fifty thousand dollars ($50,000) in annual sales from the on-site sale of tobacco products and the rental of on-site humidors, not including any sales from vending machines;

D. Such registration shall be subscribed by the owner or officer of the business completing the form and shall contain a written declaration that it is made under the penalties of perjury. (Ord. 2006-6 § 1 (part))

9.39.030 Registration deadlines.

Businesses required to register shall register in the initial year of the effective date of the ordinance codified in this chapter by October 1, 2006, and each subsequent year by January 31st. Failure to register by the deadline shall suspend any exemption from the smoking restrictions until proper registration has been completed. (Ord. 2006-6 § 1 (part))

9.39.035 List of registered businesses provided by City Clerk.

The City Clerk shall deliver to the Chief of Police a list of registered “cigar-tobacco bars” in the city of Glendale. (Ord. 2006-6 § 1 (part))

9.39.040 Radius of area to be included in the entryway.

As provided in C.R.S. Sections 25-14-203(7) and 25-14-207(2)(a), Glendale specifies the radius of zero (0) feet for the area included within an entryway. (Ord. 2006-6 § 1 (part))

9.39.050 Repeal of Colorado Clean Indoor Air Act.

This chapter is only intended to act as a supplement to the Colorado Clean Indoor Air Act. Therefore, if the Colorado Clean Indoor Air Act is repealed, enforcement of the provisions of this chapter shall be suspended. (Ord. 2006-6 § 1 (part))
