12.12.010 Application of chapter.

This chapter shall not apply to facilities, the construction of which was commenced or completed prior to June 3, 1957. (Prior code § 15-41)

12.12.020 Permit—Required.

Prior to the installation of facilities on any street, all public utilities subject to the jurisdiction of the Public Utilities Commission of Colorado shall first obtain a permit as provided in this chapter. (Prior code § 15-47)

12.12.030 Permit—Application.

A public utility which desires a permit required by this chapter for facilities on existing streets shall apply to the City Clerk for such permit by presenting the plans and specifications for the facilities to be added. (Prior code § 15-48)

12.12.040 Permit—Conditions for issuance.

A.    Upon application for a permit required by this chapter for facilities on existing streets, the City Clerk shall issue such permit upon the condition that the applicant shall repair the street and indemnify the city and any and all persons from any damages which may be sustained by reason of the construction, maintenance, and operation of the facility for which the permit shall be issued. In the event that the City Clerk refuses to issue such permit, the applicant may apply to the City Council, which may issue or reject the application for the permit.

B.    In the event that such application shall be made for the construction, maintenance and operation of the facilities other than upon existing streets upon like presentation of plans and specifications as provided in Section 12.12.020, the application shall be made to the City Council, which shall grant or reject the permit. The condition prescribed in subsection A of this section shall also apply to such issuance. (Prior code § 15-49)

12.12.050 Application fee.

Upon making any application for a permit required by this chapter, any applicant not having a franchise shall pay to the City Clerk the sum of five dollars ($5.00) which shall be placed in the general fund of the city. (Prior code § 15-50)
