TORT LIABILITY

2.16.010 Code provisions.
The City or its officers, employees or agents shall not be liable, nor is liability created, assumed or implied, by the adoption and/or enforcement of this code, nor by the act or failure to act, pursuant to the provisions of this code.

2.16.020 Drivers of City-owned vehicles or emergency vehicles.
Provisions of this code applicable to the drivers of vehicles upon the streets and highways shall apply to the drivers of all vehicles owned or operated by the City, subject to such specific exceptions as may apply to authorized emergency vehicles. No liability of the City or its officers, employees or agents shall be created or implied by the operation of authorized emergency vehicles unless the emergency vehicle is operated in such a manner as to indicate a willful and wanton disregard for the safety of other persons or property.
