2.20.010 Purpose.
This chapter is enacted pursuant to Sections 36516 and 36516.5 of the Government Code authorizing the council to provide by ordinance that each member of the council shall receive a prescribed salary, the amount of which is based upon the population of the city as determined by estimates made by the State Department of Finance and that there may be five percent increment increases each calendar year.

2.20.020 Designated.
A. Pursuant to said Government Code sections, the prescribed salary allowed in cities over seventy-five thousand up to and including one-hundred and fifty thousand in population, would provide a maximum salary of six hundred dollars per month for each city councilmember, plus the five percent increment increases permitted by Government Code section 36516(c) for each calendar year from the operative date of the last adjustment in salary. Each member of the council of the city shall receive, as salary, the sum of eight hundred twenty-nine dollars per month, inclusive of the 5 percent increment increases since the last adjustment in salary. Subject to subsection B below, said salary shall be payable at the same time and in the same manner as the salaries that are paid to other officers and employees of the city.
B. Pursuant to the provisions of Government Code section 36516.5, the foregoing increase in salary shall be effective at the beginning of the next term of office of the councilmembers beginning a new term of office. Prior to the effective date of said salary increase, councilmembers shall continue to receive their current salaries.

2.20.030 Reimbursement.
Salaries paid under this chapter are and shall be exclusive of any amount payable to each member of the council as reimbursement for actual and necessary expenses incurred by him in the performance of official duties for the city. (Ord. 1266 §3, 1985: Ord. 924 §3, 1977).
2.20.040 Council vacancies.
A. If a vacancy occurs on the City Council other than the office of the Mayor, the City Council shall, within 30 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy as provided by subsection (b) of Government Code Section 36512. If the City Council elects to fill the vacancy by appointment, the person appointed shall hold office only until the date the City Council declares the results of a special election, which shall immediately be called to fill the remainder of the term as permitted under subsection (c)(3) of Government Code Section 36512. The special election may be held, at the City Council’s choosing, either on the date of the next regularly established election or regularly scheduled municipal election to be held throughout the City not less than 114 days from the call of the special election, as provided by subsection (c)(3) of Government Code Section 36512.
B. The provisions of this section shall not apply to the office of the Mayor. A vacancy in the office of the Mayor shall be filled in accordance with the provisions of Government Code Section 34902. (Ord. 1788, Added, 10/09/2007).
