14.09.097.010 Purpose.

The AG-Agriculture district provides for the long-term commercial raising of produce and farm animals and associated or similar uses related to the operation of a farm or ranch in areas designated for agricultural use in the General Plan. The AG district also provides for agricultural uses on lands which, due to their location or lack of prime soils, would be appropriate for urban development at some future time when adequate infrastructure and public services can be provided. This chapter establishes the permitted and conditional uses allowed in the AG district, and also establishes development standards for uses in this district. The provisions of this chapter are established to achieve the following purposes:

A. To protect lands for long-term agricultural uses which are suitable for raising crops or livestock, with limited agricultural support industries and services,

B. To provide for interim agricultural uses on lands which may be appropriate for future development;

C. To provide for single family dwellings and accessory uses appurtenant to a principal agricultural use;

D. To prevent the intrusion of urban development into prime agricultural areas where conflicting uses would not be compatible and where such intrusion would make agricultural production uneconomical or unfeasible;

E. To implement the goals, objectives, and policies of the Zoning Ordinance, the Development Code, and the General Plan.

14.09.097.020 Applicability.

The AG district development standards are minimum requirements and shall not be construed to prevent the City Council, the Planning Commission, or the Director from imposing, as part of a project approval, specific conditions which may be more restrictive, in order to meet the intent of these regulations. Site development standards are provided in Table 14.09.097.01 of this chapter.

A. The standards established by this chapter apply to land development permits and approvals that are subject to the Zoning Ordinance and are applicable to new construction, to site improvements, and to the modification of existing structures. Such new construction or modifications shall be subject to the development standards contained in this chapter, unless otherwise specified in the applicable zoning district, or in Chapter 14.09.135, Non-Conforming Uses and Structures, of the Zoning Ordinance.

B. Any requirements or standards established by an adopted specific plan or policy plan shall supersede the standards of the applicable zoning district and the provisions of this chapter.

C. These standards shall apply unless a deviation has been granted through a planned development, a variance, or an administrative clearance, in accordance with the provisions of this division.

D. All uses are also subject to the provisions of Chapters 14.09.127 through 14.09.139, Supplemental Standards, of this division, which includes, but is not limited to, Performance Standards, Off-Street Parking and Loading, Tree Preservation, Signs, Airport Land Use Compatibility, and Non-Conforming Uses and Structures. In addition, the provisions of Chapter 14.09.139, Additional Standards Applicable to all Zoning Districts, and the Water Efficient Landscape Requirements, of this Title shall apply. 14.09.097.030 Permitted Uses.

A. The following uses are permitted uses in the AG district, and include, but are not limited to:

1. Accessory uses and structures to a permitted use, including farm employee housing, and the processing of agricultural products produced on the site;

2. Agricultural uses designated as a permitted use by an applicable policy plan or specific plan;

3. Grazing of livestock, subject to the provisions of Section 14.09.097.070.A. of this chapter;

4. Growing of fruit and nut trees, vegetables, grains, field crops, horticultural specialties, and timber;

5. Single family dwellings and the following accessory uses:

a. Accessory uses in accordance with the provisions of Section 14.09.075.030.A., Accessory Uses to Residential Dwellings, of this division;

b. Raising of poultry, rabbits, and other small animals, subject to Section 14.09.097.070.B. of this chapter;

6. Seasonal roadside stands for the sale of agricultural produce grown on site;

7. Stables and corrals for the keeping of livestock, subject to the provisions of Section 14.09.097.070.C. of this chapter;

8. Telecommunication Facility, Minor, in accordance with the provisions of Chapter 14.09.125, Telecommunication Facilities, of this division. (Ord. 1599, §25, 1998)

14.09.097.040 Conditional Uses.

A. The following conditional uses are allowed in the AG district upon the granting of a conditional use permit, in accordance with the provisions of Chapter 14.09.110 of this division, and include:

1. Accessory uses and structures to a conditional use;

2. Agricultural uses designated as a conditional use by an applicable policy plan or specific plan;

3. Equestrian facilities;

4. Farm equipment service and repair establishments;

5. Golf courses;

6. Kennels and animal boarding;

7. Plant nurseries provided that for any portion of the nursery located within 250 feet of a residential district, all equipment, supplies, and merchandise, other than plants, shall be kept within a completely enclosed building and that all fertilizers shall be stored and sold in packaged form only;

8. Public utility structures and facilities;

9. Permanent roadside stands for the sale of agricultural produce grown on the site;

10. Agricultural educational facilities;

11. Guest ranches;

12. Veterinarian offices;

13. Telecommunication Facility, Major, in accordance with the provisions of Chapter 14.09.125, Telecommunication Facilities, of this division. (Ord. 1599, §25, 1998)

14.09.097.050 Site Development Standards.

The site development standards for site area, site coverage, required yards, distance between structures, and structure height shall be as shown in Table 14.09.097.01 of this chapter.

14.09.097.060 Screening.

When located on a site abutting on or across a street or alley from an residential district, a business, service, or process not conducted within a completely enclosed structure, or the open storage of produce, materials, or equipment shall be screened by a solid fence or wall, vine covered fence or compact evergreen hedge not less than six feet in height, if determined by the decision-maker to be unsightly.

14.09.097.070 Special District Provisions.

The following special district provisions shall apply:

A. Grazing shall be on pasture land. A minimum site area of 2 acres shall be required. Seasonal, supplemental feed shall be permitted. Grazing shall not include the confining of livestock in enclosures such as feedlots or corrals where feed is provided on a regular basis.

B. The raising of poultry, rabbits, and other small animals for non-commercial purposes on a site at least 1 acre in area, as follows:

1. There shall be at least 1,000 square feet of site area for each fowl or animal;

2. No structure housing poultry or other small animals shall be closer than 50 feet to a dwelling on the site or 100 feet to a property line;

3. The minimum site area requirements shall not apply for the raising of small animals when in conjunction with a 4-H or similar type project.

C. Stables and Corrals. When livestock are kept in a stable or corral, the following standards shall apply:

1. A minimum site area of one acre shall be required for the keeping of up to two head of livestock; one additional animal may be kept for every additional area of one acre, except that a feedlot shall not be permitted;

2. No stable or corral shall be located closer than 50 feet to the rear of a dwelling on the site, or closer than 100 feet to a property line;

3. No stable or corral shall be used as a feedlot.

(1)    Minimum Site Area: A parcel of not less than one acre may be created for public utility structures and facilities.

(2)    Maximum Site Area Coverage. Up to 17,500 square feet of building area shall be permitted on a site of 20 acres or less. For sites greater than 20 acres in area, the decision-maker may approve a site area coverage greater than 2 percent in conjunction with a project approval.

(3)    Minimum Yard From Any Property Line. A greater distance may be required by the decision-maker on the basis of the standards adopted pursuant to the Uniform Fire Code related to the fire protection system serving the site.

(4)    Minimum Distance Between Structures. Applies to the minimum distance between a structure used for human habitation and another structure. The minimum distance between a structure used for human habitation and a structure housing livestock shall be 50 feet. A greater distance may be required by the decision-maker on the basis of the standards adopted pursuant to the Uniform Fire Code related to the fire protection system serving the site.

(5)    Maximum Building Height. Exceptions to building height: Towers, spires, cupolas, chimneys, penthouses, water tanks, flagpoles, monuments, scenery lofts, radio and television aerials, light poles, telecommunication equipment, transmission towers, fire towers, and similar structures and necessary mechanical appurtenances covering not more than 10 percent of the ground area covered by the structures may be erected to a height not more than 25 feet above the height limit prescribed by the regulations for the district in which the site is located. Electric utility poles and towers shall not be subject to the height limits prescribed in the district regulations.
