5-3-1 WRECKED OR DISMANTLED VEHICLES:

A.    Business Prohibited: It shall be unlawful for any person to engage in the business of buying, selling, keeping, storing or dismantling of any automobile or part thereof (other than such motor vehicles as may be in use by the owner for the transportation and/or occupation and business and also excepting therefrom garages, repair shops and duly licensed auto wrecking establishments actively engaged in the regular business as such at the effective date hereof) anywhere in the corporate limits of the city. Any violation of this subsection shall be deemed a misdemeanor and each twenty four (24) hour period that such activity shall continue shall be deemed a separate offense.

B.    Storage Prohibited: It shall be unlawful for any person to keep or store any wrecked or partially dismantled vehicle, or any part thereof, anywhere within the corporate limits of the city; however, it shall be lawful to keep or store a wrecked or partially dismantled vehicle during such time that repairs are being made by the owner of the vehicle, and it shall further be lawful for the continued business operation of a previously permitted use that was specifically granted by the city council. Any violation of this subsection shall be deemed a misdemeanor, and each twenty four (24) hour period that such activity continues shall be deemed a separate offense. (1988 Code)

5-3-2 OPERATION OF VEHICLES ON APPROACH OF AUTHORIZED EMERGENCY VEHICLES:

Upon the approach of any authorized emergency vehicle giving audible signals by bell, siren or whistle, and one lighted lamp displaying a red or blue light, the driver of any other vehicle shall immediately drive such vehicle to a position as near as possible and parallel to the curb on the driver’s right hand side, or if on a one-way street, drive to either side of the roadway, clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle has passed, unless otherwise directed by a police officer. It shall be unlawful for the driver of any vehicle, other than one on official business connected therewith, to follow any authorized emergency vehicle at a distance of less than one block or park such vehicle within the block where the emergency vehicle has stopped in answer to an alarm. 5-3-3 DUTY TO GIVE INFORMATION IN ACCIDENT INVOLVING DAMAGE TO A VEHICLE:

The driver of any vehicle involved in an accident resulting in damage to any vehicle which is driven or attended by any person shall, at the scene of the accident, give his name, address and, if available, at the scene of the accident, he shall exhibit his driver’s license, proof of registration and certificate or proof of liability insurance to the person struck or to the driver or person attending any vehicle collided with. 5-3-4 DUTY UPON STRIKING UNATTENDED VEHICLE:

The driver of any vehicle which collides with any vehicle, which is unattended, shall immediately stop and shall then and there either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle striking the unattended vehicle or shall leave in a conspicuous place in the vehicle struck a written notice giving the name and address of the driver and of the owner of the vehicle doing the striking. 5-3-5 DUTY UPON STRIKING FIXTURES UPON A HIGHWAY:

The driver of any vehicle involved in an accident resulting in damage to fixtures or other property legally upon or adjacent to a highway shall take reasonable steps to locate and notify the owner or person in charge of the property of the fact, of his name and address, the name of his insurance agent or company if he has automobile liability insurance, the motor vehicle registration number of the vehicle he is driving, and upon request and if available exhibit his driver’s license. 5-3-6 PENALTIES:

Any person violating one of the provisions of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding three hundred dollars ($300.00) or be imprisoned in the county jail for a period not exceeding six (6) months or be both so fined and imprisoned.
