ARTICLE I. INITIATIVE AND REFERENDUM²

Sec. 13-1. Right of people.

The people of this city shall have the right to enact ordinances through the initiative process, and to repeal ordinances through the referendum process, according to the procedures set forth herein and as provided by Idaho Code, Section 50-501, as currently constituted or as may be hereafter amended. ARTICLE II. PRECINCTS AND POLLING PLACES³

Sec. 13-24. Election precincts – Designated.

The city of Lewiston is hereby divided into twenty-eight (28) election precincts to be known and designated as Lewiston Precincts 1 through 26, Hatwai Precinct to be known as [Lewiston] Precinct No. 32 and Tammany Precinct to be known as [Lewiston] Precinct No. 39, which precincts shall, as near as possible and practicable, conform to the like-designated county election precincts within the city of Lewiston, all as set forth in sections 13-25 through 13-28, inclusive, of this code as amended hereinafter. Sec. 13-25. Same – Boundaries.

The boundaries of the city election precincts shall be as follows:

Lewiston Precinct No. 1: Commencing at a point where U. S. Highway 95 North intersects the mid-channel of the Clearwater River; thence westerly along the mid-channel of the Clearwater River to its intersection with the Snake River; thence down the mid-channel of the Snake River to the Idaho-Washington state line; thence southerly along the Idaho-Washington state line, which is also the mid-channel of the Snake River, to its intersection with the Interstate Bridge; thence easterly to a point where Prospect Avenue and North Prospect Avenue, if extended westerly, would intersect; thence continue easterly along the center line of North Prospect Avenue to intersection with center line of 5th Street; thence north along the center line of 5th Street to intersection with center line of F Street; thence easterly along the center line of F Street to intersection with center line of New 6th Street; thence southerly along center line of New 6th Street to intersection with center line of F Street; thence easterly along the center line of F Street to its intersection with center line of 9th Street; thence southerly along the center line of 9th Street and 9th Street grade to north boundary line of Trevitt Park; thence easterly along the south boundary of south part of Lot 5 of Acres to its intersection with center line of 13th Street; thence southerly along the center line of 13th Street to its intersection with center line of 6th Avenue; thence along the center line of 6th Avenue to its intersection with center line of Park Street; thence along the center line of 6th Avenue, if extended easterly, to intersection with center line of 14th Street; thence continuing along the center line of 6th Avenue to its intersection with center line of 16th Street; thence southerly along the center line of 16th Street to its intersection with center line of 7th Avenue; thence easterly along the center line of 7th Avenue to its intersection with the center line of 21st Street; thence northerly along the center line of 21st Street to its intersection with Main Street and U. Lewiston Precinct No. 2: Commencing at a point which is the intersection of mid-channel of the Snake River (also Idaho-Washington state line) and Interstate Bridge; thence easterly to a point where the center lines of Prospect Avenue and North Prospect Avenue, if extended westerly, would intersect; thence easterly along the center line of North Prospect Avenue to its intersection with the center line of 5th Street; thence northerly along the center line of 5th Street to its intersection with center line of F Street; thence easterly along the center line of F Street to its intersection with center line of New 6th Street; thence southerly along the center line of New 6th Street to its intersection with center line of F Street; thence easterly along the center line of F Street to its intersection with center line of 9th Street; thence southerly along the center line of 9th Street and 9th Street grade to its intersection with center line of 5th Avenue; thence westerly along the center line of 5th Avenue, if extended westerly, to its intersection with the mid-channel of the Snake River, which is also the Idaho-Washington state line; thence northerly down the mid-channel of the Snake River to point of beginning.

Lewiston Precinct No. 3: Commencing at a point which is the intersection of mid-channel of the Snake River, which is also the Idaho-Washington state line, and 5th Avenue, if extended westerly; thence easterly along center line of 5th Avenue, if extended and 5th Avenue to its intersection with center line of 8th Street; thence southerly along center line of 8th Street to its intersection with center line of 7th Avenue; thence westerly along center line of 7th Avenue to its intersection with center line of 4th Street; thence southerly along center line of 4th Street to its intersection with center line of 10th Avenue; thence westerly along center line of 10th Avenue to its intersection with center line of Prospect Avenue; thence southerly along center line of Prospect Avenue to its intersection with center line of 19th Avenue; thence westerly along center line of 19th Avenue, if extended westerly, to mid-channel of Snake River, which is also Idaho-Washington state line, thence northerly down the mid-channel of Snake River to point of beginning.

Lewiston Precinct No. 4: Commencing at a point which is the intersection of northwest corner of Trevitt Park and center line of 9th Street grade; thence easterly along the north line of Trevitt Park and south line of south part of Lot 5 of Acres Addition to intersection with center line of 13th Street; thence southerly along the center line of 13th Street to intersection with the center line of 6th Avenue; thence easterly along the center line of 6th Avenue to its intersection with center line of Park Street; thence along the center line of 6th Avenue, extended west from 14th Street, to its intersection with center line of 16th Street; thence southerly along the center line of 16th Street to its intersection with center line of 7th Avenue; thence easterly along center line of 7th Avenue to its intersection with center line of 21st Street; thence southerly along the center line of 21st Street to its intersection with center line of 10th Avenue; thence westerly along the center line of 10th Avenue to its intersection with center line of 13th Street; thence northerly along center line of 13th Street to its intersection with center line of 9th Avenue; thence westerly along the center line of 9th Avenue to its intersection with center line of 11th Street; thence northerly along center line of 11th Street to its intersection with center line of 8th Avenue; thence westerly along center line of 8th Avenue to its intersection with center line of 10th Street; thence northerly along center line of 10th Street to its intersection with center line of 7th Avenue; thence westerly along center line of 7th Avenue to its intersection with center line of 8th Street; thence northerly along center line of 8th Street to point of beginning.

Lewiston Precinct No. 5: Commencing at a point where U. S. Highway 95 North intersects with mid-channel of the Clearwater River; thence easterly along the mid-channel of the Clearwater River to its intersection with center line of 26th Street, if extended northerly; thence southerly along the center line of 26th Street, if extended northerly, and 26th Street to its intersection with center line of 8th Avenue; thence easterly along the center line of 8th Avenue to its intersection with center line of 29th Street; thence southerly along the center line of 29th Street to its intersection with center line of 11th Avenue; thence westerly along center line of 11th Avenue to its intersection with center line of 21st Street, thence northerly along the center line of 21st Street to its intersection with center line of Main Street, which is also U. S. Highway 95 North, as it now exists; thence easterly and northerly along the center line of U. S. Highway 95, as it now exists, to point of beginning.

Lewiston Precinct No. 6: Commencing at a point in mid-channel of the Clearwater River where the center line of 26th Street north of Main Street, if extended northerly, would intersect the same; thence southerly and along the center line of said street to its intersection with Main Street; thence westerly along the center line of Main Street to its intersection with 26th Street on the south side of Main Street; thence southerly along the center line of 26th Street to its intersection with 8th Avenue; thence easterly along the center line of 8th Avenue to the center line of 29th Street; thence southerly along the center line of 29th Street to its intersection with the south line of the north half of the northeast quarter of Section 5, Township 35 North, Range 5 West, Boise Meridian; thence easterly along the south line of the north half of the northeast quarter of Section 5, Township 35 North, Range 5 West, Boise Meridian to a point which is the southeast corner of the northeast quarter of northeast quarter of Section 5, Township 35 North, Range 5 West, Boise Meridian; also being the east city limits line; thence north along the east city limits line to a point in mid-channel of the Clearwater River; thence down the Clearwater River to the true point of beginning.

Lewiston Precinct No. 7: Commencing at a point which is the intersection of center lines of 7th Avenue and 4th Street; thence southerly along center line of 4th Street to intersection with center line of 10th Avenue; thence westerly along center line of 10th Avenue to its intersection with center line of Prospect Avenue; thence south along center line of Prospect Avenue to its intersection with center line of 19th Avenue; thence westerly along the center line of 19th Avenue, if extended westerly to center line of Snake River Avenue; thence southerly along center line of Snake River Avenue to its intersection with center line of Southway; thence easterly along center line of Southway to its intersection with center line of 16th Avenue; thence easterly along center line of 16th Avenue to its intersection with center line of 8th Street; thence northerly along the center line of 8th Street to its intersection with the center line of 7th Avenue; thence westerly along the center line of 7th Avenue to the point of beginning.

Lewiston Precinct No. 8: Commencing at the point of intersection of 8th Street grade and 25th Avenue; thence westerly along 25th Avenue, if extended westerly, to its intersection with Snake River Avenue; thence northerly along the center line of Snake River Avenue to the intersection of Southway; thence easterly along the center line of Southway to the intersection with the center line of 16th Avenue; thence easterly along the center line of 16th Avenue to its intersection with the center line of 8th Street; thence southerly along the center line of 8th Street to the center line of 25th Avenue, the true point of beginning.

Lewiston Precinct No. 9: Commencing at the point of intersection of the center lines of 8th Street grade and 20th Avenue; thence easterly along 20th Avenue, if extended easterly, to its intersection with center line of 12th Street, if extended southerly; thence northerly along center line of 12th Street to its intersection with the center line of 11th Avenue; thence easterly along the center line of 11th Avenue to its intersection with center line of 13th Street; thence northerly along the center line of 13th Street to its intersection with the center line of 9th Avenue; thence westerly along the center line of 9th Avenue to its intersection with the center line of 11th Street; thence northerly along the center line of 11th Street to its intersection with 8th Avenue; thence westerly along the center line of 8th Avenue to its intersection with the center line of 10th Street; thence northerly along the center line of 10th Street to its intersection with the center line of 7th Avenue; thence westerly along the center line of 7th Avenue to its intersection with center line of 8th Street; thence southerly along the center line of 8th Street and 8th Street grade to the point of beginning.

Lewiston Precinct No. 10: Commencing at the point of intersection of the center lines of 12th Street, if extended southerly, and 20th Avenue, if extended easterly; thence easterly along 20th Avenue, if extended easterly, to its intersection with the center line of 17th Street; thence northerly along center line of 17th Street to its intersection with the center line of 10th Avenue; thence westerly along the center line of 10th Avenue to its intersection with the center line of 13th Street; thence southerly along the center line of 13th Street to its intersection with the center line of 11th Avenue; thence westerly along center line of 11th Avenue to its intersection with center line of 12th Street; thence southerly along center line of 12th Street, if extended southerly, to the point of beginning.

Lewiston Precinct No. 11: Commencing at the point of intersection of center lines of 21st Avenue and 17th Street; thence easterly along 21st Avenue, if extended easterly, to southeast corner of Section 6, Township 35 North, Range 5 West, Boise Meridian; thence continue easterly along the section line between Sections 5 and 8 to southeast corner of Section 5, said point being on the east city limits line; thence northerly along east line of Section 5 and said east city limits line to the southeast corner of the northeast quarter of the northeast quarter of Section 5; thence westerly along the south half of the north half of the northeast quarter of Section 5, to the point of intersection of center lines of 29th Street and 11th Avenue; thence westerly along center line of 11th Avenue to its intersection with the center line of 21st Street; thence northerly along center line of 21st Street to its intersection with center line of 10th Avenue; thence westerly along center line of 10th Avenue to its intersection with the center line of 17th Street; thence southerly along center line of 17th Street to point of beginning.

Lewiston Precinct No. 12: Commencing at the northwest corner of the southwest quarter of the northeast quarter of Section 12, Township 35 North, Range 6 West, Boise Meridian; thence southerly along center line of Section 12 to the northwest corner of the southwest quarter of the southeast quarter of said Section 12; thence easterly along the north line of the southwest quarter of the southeast quarter of Section 12, Township 35 North, Range 6 West to the city limits line; thence southerly along the city limits line; thence easterly along the city limits line; thence northerly along the city limits line to point of intersection with Snake River Avenue; thence following center line of Snake River Avenue northerly to its intersection with 25th Avenue, if extended westerly; thence easterly along center line of 25th Avenue, if extended westerly, to the true point of beginning.

Lewiston Precinct No. 13: Beginning at the southwest corner of the northeast quarter of the southeast quarter of Section 12, Township 35 North, Range 6 West; thence westerly to the southeast corner of Lot 3 of said Section 12; thence northerly along the east lines of Lots 3 and 2 to the center line of 25th Avenue extended westerly, which is the northeast corner of Lot 2 of said Section 12; thence easterly along the center line of 25th Avenue to a point, said point being the center line of 8th Street, if extended; thence northerly along the center line of 8th Street to a point, said point being 20th Avenue, if extended westerly; thence easterly along the center line of 20th Avenue extended to the center line of 17th Street; thence southerly along the center line of 17th Street and 5th Street Lewiston Orchards, to the center line of Preston Avenue. Westerly along the center line of Preston Avenue to the southwest corner of the northeast quarter of the southeast quarter of Section 12, Township 35 North, Range 6 West, Boise Meridian, to the true point of beginning. Also including that portion of Lots 11, 12, 15, and 16 in the platted Mayfair 3rd Addition to the City of Lewiston.

Lewiston Precinct No. 14: Commencing at a point where 17th Street intersects the north line of Section 7, Township 35 North, Range 5 West, Boise Meridian; thence easterly on the north line of said Section 7 and Section 8, Township 35 North, Range 5 West, Boise Meridian, to a point, said point being the northeast corner of the northwest quarter of the northwest quarter of said Section 8; thence southerly along the east line of the northwest quarter of the northwest quarter and the southwest quarter of the northwest quarter of Section 8, Township 35 North, Range 5 West, Boise Meridian, to a point where 7th Street and Stewart Avenue intersect; thence southerly on the center line of 7th Street to a point where 7th Street and Warner Avenue intersect; thence westerly along the center line of Warner Avenue to the intersection of the center line of 5th Street; thence north along the center line of 5th Street and 17th Street as they merge to a point on the north line of Section 7, Township 35 North, Range 5 West, Boise Meridian, the true point of beginning.

Lewiston Precinct No. 15: Commencing at a point which is the northeast corner of the northwest quarter of the northwest quarter of Section 8, Township 35 North, Range 5 West, Boise Meridian; thence easterly along the line between Sections 5 and 8, Township 35 North, Range 5 West, Boise Meridian, to the common section corners of Sections 4, 5, 8, and 9, Township 24 North, Range 5 West, Boise Meridian; thence southerly along the east section line of Section 8, Township 35 North, Range 5 West, Boise Meridian (10th Street) to the southeast corner of the northeast quarter of said Section 8 (Stewart Avenue); thence westerly along the south line of the northeast quarter of Section 8 (Stewart Avenue) to the intersection of 9th Street; thence southerly along the center line of 9th Street to a point where said line intersects Warner Avenue; thence westerly along center line of Warner Avenue to its intersection with 7th Street; thence northerly along the center line of 7th Street to its intersection with Stewart Avenue; continue northerly along the east boundary line of the southwest quarter of the northwest quarter and northwest quarter of the northwest quarter of Section 8, Township 35 North, Range 6 West, Boise Meridian, to the northeast corner of the northwest quarter of the northwest quarter of Section 8, Township 35 North, Range 5 West, Boise Meridian, being the true point of beginning.

Lewiston Precinct No. 16: Beginning at the southwest corner of the northeast quarter of the southeast quarter of Section 12, Township 35 North, Range 6 West, Boise Meridian; thence easterly along Preston extended and Preston Avenue to a point, said point being the center line of 5th Street Lewiston Orchards. Lewiston Precinct No. 20: Commencing at the intersection of Bryden Avenue and 9th Street; thence easterly along the center line of Bryden Avenue to its intersection with 12th Street; thence southerly along the center line of 12th Street to its intersection with Grelle Avenue; thence westerly along the center line of Grelle Avenue to its intersection with 9th Street; thence northerly along the center line of 9th Street to its intersection with Bryden Avenue, the true point of beginning.

Lewiston Precinct No. 21: Beginning at the intersection of Grelle Avenue and 9th Street; thence easterly along the center line of Grelle Avenue to its intersection with 11th Street; thence southerly along the center line of 11th Street to its intersection with Powers Avenue; thence easterly along the center line of Powers Avenue to its intersection with 14th Street; thence southerly along the center line of 14th Street to its intersection with Richardson Avenue; thence westerly along the center line of Richardson Avenue to the center line of 9th Street, extended southerly; thence northerly along 9th Street extended and 9th Street to the center line of Grelle Avenue, the true point of beginning.

Lewiston Precinct No. 22: Commencing at the corner common to Sections 4, 3, 9 and 10 of Township 35 North, Range 5 West, of the Boise Meridian; thence southerly along the section line common to Sections 9 and 10 to its intersection with Warner Avenue and 14th Street; thence southerly along the center line of 14th Street to its intersection with Powers Avenue; thence westerly along the center line of Powers Avenue to its intersection with 11th Street; thence northerly along the center line of 11th Street to its intersection with Grelle Avenue; thence easterly along the center line of Grelle Avenue to its intersection with 12th Street; thence northerly along the center line of 12th Street to its intersection with Warner Avenue; thence northerly along the center of section line of Section 9 to its intersection with the north section line of Section 9; thence easterly to the point of beginning.

Lewiston Precinct No. 23: Commencing at the intersection of Warner Avenue and 14th Street; thence east along the north city limits line to its intersection with 17th Street; thence south along the west line of the east half of the northeast quarter and the southeast quarter of Section 15, Township 35 North, Range 5 West, Boise Meridian to the intersection of Grelle Avenue and 17th Street to the south; thence west along the center line of Grelle Avenue to its intersection with 14th Street; thence north along the center line of 14th Street to the point of beginning.

Lewiston Precinct No. 24: Commencing at the intersection of 14th Street and Grelle Avenue; thence east along the center line of Grelle Avenue to its intersection with 17th Street; thence south along the center line of 17th Street to its intersection with Richardson Avenue; thence west along the center line of Richardson Avenue to its intersection with 14th Street; thence north along the center line of 14th Street to its intersection with Grelle Avenue, the true point of beginning.

Lewiston Precinct No. 25: Commencing at the intersection of Powers Avenue and 17th Street; thence north along the center line of 17th Street and the west line of the east half of the northeast quarter and the southeast quarter of Section 15, Township 35 North, Range 5 West, Boise Meridian to the intersection of 17th Street and Warner Avenue; thence south and east along the city limits line of Burrell Avenue; thence east on Burrell Avenue to the intersection of 22nd Street; thence south along the center line of 22nd Street to its intersection with Powers Avenue; thence west along the center line of Powers Avenue to the point of beginning.

Lewiston Precinct No. 26: Commencing at the intersection of Powers Avenue and 17th Street; thence east along the center line of Powers Avenue to the intersection of 22nd Street; thence south along the center line of 22nd Street to the intersection of Richardson Avenue also being the south city limits line; thence east along the city limits line to the intersection with 17th Street; thence north along the center line of 17th Street to the point of beginning.

Lewiston Precinct No. 32: All that area north of the Clearwater River and south of the current city limits.

Lewiston Precinct No. 39: All that area east of 22nd Street and south of Burrell Avenue and north of Cedar Avenue and west of the current city limits. Sec. 13-26. Polling times.

The polls of the city of Lewiston shall open at 8:00 a.m. for municipal elections and shall close at 8:00 p.m., as provided by Idaho Code, Section 50-453. (Ord. No. 3883, § 1, 8-31-87)

Sec. 13-27. Polling places.

The polling places for each city election precinct shall be established by resolution approved by the city council. (Ord. No. 3382, § 4, 7-11-77; Ord. No. 3791, § 2, 8-19-85)

Sec. 13-28. Date of general city election, procedure.

The city of Lewiston shall conduct a general city election on the first Tuesday following the first Monday in November in each odd-numbered year. Said election shall be held in compliance with Idaho Code, Sections 50-401 through 50-432, as currently constituted or as hereafter amended. (Ord. No. 4030, § 3, 3-23-92)

ARTICLE III. REPLACEMENT FOR RESIGNED COUNCILPERSONS⁴

Sec. 13-29. Filling of vacancy by appointment.

Whenever a vacancy occurs in the council, the vacancy may be filled until the next city election by appointment of the city council. Such appointee shall serve only until the next general city election, at which time, such vacancy shall be filled for the balance of the original term by the election process. (Ord. Sec. 13-30. Separate position to be established on ballot when necessary to fill remainder of original terms by election.

When necessary to fill the remainder of original terms by the election process, a separate position shall be established on the general municipal election ballot apart from other council positions. The ballot shall specify that the term of office for the separate position shall be for two (2) years, and until his successor is elected and qualified. (Ord. No. 3504, § 1, 9-4-79)

Sec. 13-31. Candidates to specify term for which they are seeking election.

Candidates shall specify if they are candidates for the two-year term of office and candidates for the two-year term shall not be candidates for any four-year term on the ballot. The person elected to fill the remaining two-year term shall take office at the first council meeting following the general city election. (Ord. No. 3504, § 1, 9-4-79)
